1. Introducción

La presente declaración de confidencialidad explica las razones del tratamiento de los datos, la forma en que recabamos y manejamos todos los datos personales facilitados y garantizamos su protección, el uso que se hace de dicha información y los derechos que los interesados pueden ejercer en relación con sus propios datos (acceso, rectificación, bloqueo, etc.).

The European institutions are committed to protecting and respecting your privacy. As this service/application collects and further processes personal data, Regulation (EU) 2018/1725 , of the European Parliament and of the Council of 23 October 2018 on the protection of natural persons with regard to the processing of personal data by the Union institutions, bodies, offices and agencies and on the free movement of such data, is applicable.

La presente declaración de privacidad se refiere al tratamiento de los datos necesarios para el correcto funcionamiento del Portal InvestEU (el portal). La Comisión Europea creó el portal en virtud del Reglamento (UE) 2021/523 del Parlamento Europeo y del Consejo, de 24 de marzo de 2021, por el que se establece el Programa InvestEU. La Decisión (UE) 2021/626 establece las especificaciones técnicas del portal como base de datos transparente de proyectos de inversión actuales y potenciales en la Unión Europea.

2. ¿Por qué tratamos los datos personales?

Finalidad de las operaciones de tratamiento:

Operational staff in charge of the practical organisation of the functioning of the Portal, supervised by the Head of Unit ECFIN.L.2 (referred to hereafter as Data Controller), collects and uses your personal information with the sole purpose to support and contribute to the management of the Portal according to Article 26 of Regulation (EU) 2021/523 and Commission Implementing Decision (EU) 2021/626.

Legitimidad de las operaciones de tratamiento:

The data processing is considered lawful because it is necessary for the performance of tasks carried out in the public interest on the basis of the Treaties establishing the European Communities. More specifically, in order to allow for a proper functioning of the Portal as a publicly available web portal of investment projects, which acts as a platform to promote projects to potential investors worldwide, in accordance with Regulation (EU) 2021/523 and Commission Implementing Decision (EU) 2021/626.

3. ¿Qué datos recogemos y tratamos?

Los datos personales recogidos y posteriormente tratados son:

  • los nombres de las personas físicas,
  • las direcciones de correo electrónico de los posibles inversores y los promotores de proyectos,
  • additional information can be voluntarily provided in the mini biography of natural persons

4. ¿Cuánto tiempo conservamos los datos personales?

Solo guardamos los datos el tiempo necesario para cumplir la finalidad de su recogida o de su tratamiento posterior. Los datos personales relacionados con promotores de proyectos o inversores se conservan en el servicio encargado durante dos años tras una solicitud explícita de supresión o tras la supresión automática del proyecto en el Portal.

5. ¿Cómo protegemos los datos personales?

All data in electronic format (e-mails, documents, uploaded batches of data etc.) are stored either on the servers of the European Commission or of its contractors: the operations of which abide by the European Commission’s security decision of 16 August 2006 [C (2006) 3602] concerning the security of information systems used by the European Commission.

The Commission’s contractors are bound by a specific contractual clause for any processing operations of your data on behalf of the Commission. The processors have to put in place appropriate technical and organisational measures to ensure the level of security, required by the Commission.

6. ¿Quién tiene acceso a los datos personales y a quién se divulgan?

El acceso a los datos personales se otorga al personal autorizado especificado a continuación, de conformidad con el principio de la "necesidad de conocer". Dicho personal está obligado a respetar acuerdos de confidencialidad legales y, en caso necesario, otros acuerdos adicionales.

  1. Staff of operational units of the European Commission dealing with the implementation of the Portal and services charged with a monitoring or inspection task in application of Union law (e.g. internal control, internal audit).
  2. Staff of the EU Institutions, representatives of Member States and InvestEU Implementing partners dealing with the implementation of the Portal in line with Article 26 of Regulation (EU) 2021/523.
  3. Staff of OLAF, IDOC and the Legal Service of the Commission as well as staff of other DG (SG, DG BUDG and clearinghouse) upon request necessary in the context of official investigations or for audit purposes.

7. ¿Cuáles son los derechos de los interesados y cómo pueden ejercerlos?

According to Regulation (EU) 2018/1725, you are entitled to access your personal data and rectify, block or delete it in case the data is inaccurate or incomplete. You can exercise your rights by contacting the data controller, or in case of conflict the Data Protection Officer and if necessary the European Data Protection Supervisor using the contact information given at point 8 below.
