Business-to-business transactions: a comparative analysis of legal measures vs soft-law instruments for improving payment behaviour

The European Commission's Directorate-General for Internal Market, Industry, Entrepreneurship and SMEs plans to contract a study to assess the effectiveness of the measures, both regulatory and voluntary, currently used in EU countries to tackle late payment in business to business transactions.

Prevailing practices that favour businesses holding stronger market positions form a part of business culture and can be difficult to address via normal, regulatory channels. With this study, the Commission will review the range of measures throughout the EU to determine which ones prove the most effective for specific industries.The ultimate result will be EU-wide qualitative and quantitative data that will enable the Commission:

  • to assess whether the current EU legal framework on late payments in the B2B area is still fit for purpose,
  • to provide public authorities, businesses and SMEs with concrete recommendations for building a responsible payment culture in the EU.
