What is MSA?

The Master Service Arrangement (MSA) aims to specify the understandings and expectations on behalf of the European Commission with regard to the provision of EBSI Software and Services. It defines the generic terms that should be respected by the stakeholders to use and manage the EBSI Software sample implementation and/or Service.

It has to be noted that the MSA is a non-binding statement made in good faith, which is not legally enforceable against the European Commission, and which creates no new binding legal obligations on the Commission.

Any references to duties or obligations within this Arrangement should therefore be understood as a good faith statement of intent only, without any obligation of result or legal recourse in case of breaches of such duties or obligations. As such, this MSA does not require signatures between parties.

What are the different Terms?

Term

Services scope: EBSI and its related Service Offering are defined and described in this web portal. If a Client requests a Service which was not initially foreseen within EBSI, this specific Service can be addressed through the EBSI governance as per DIGITAL Europe work programme.

Term

Service modification: any modification of the Service Offering, the related Service Level Agreements (SLAs) or Master Service Arrangement must be presented to the Operational Management Board (OMB) to inform the Clients (or third parties).

Term

Compliance with the EBSI Governance: the Solution Provider and the Client must work within the EBSI governance processes and procedures as per DIGITAL Europe work programme.

Term

Financial implications: the Master Service Arrangement does not of itself create any financial obligations.

Term

Processing of sensitive information: The EBSI website is not meant to store sensitive information or process such information in any other way. The EBSI team is committed to configuring user access rights for Services related to EBSI, in order to ensure that restricted information is not accessible to unwanted parties.
