T-694/15 - Micula vs. European Commission

• The Commission takes note of today’s judgment by the General Court, which annulled a Commission’s State aid decision of 30 March 2015. In its 2015 decision, the Commission had found that the implementation of a December 2013 arbitral award (Micula v Romania) constituted incompatible State aid and, as result, ordered Romania to recover the amounts paid from the beneficiaries.
• The Commission will carefully study the judgement and reflect on possible next steps.

 
Case T-370/17 - KPN vs. European Commission

The Commission welcomes the judgment by the General Court dismissing KPN’s appeal against the Commission’s decision of August 2016, which approved, subject to conditions, a joint venture in the Netherlands between Vodafone and Liberty Global. The judgment confirms the Commission's assessment in relation to premium Pay TV sports channels and notably in relation to its assessment of the potential risk of input foreclosure with respect to the premium Pay TV channel, Ziggo Sport Totaal.

 
Case T-728/17 - Marinvest and Porting vs. European Commission

The Commission welcomes the judgment by the General Court fully upholding a Commission decision of 2017, which concluded that some measures allegedly favouring the municipal Komunala Izola Harbour in Slovenia did not constitute State aid because they were not apt to affect trade between Member States. In particular, in confirming that the Commission assessment and conclusions are well-founded, the Court confirmed the Commission’s effort to focus on cases that are likely to raise serious concerns, rather than dealing with cases having a purely local impact.

 
Case T-185/18 - Lucchini vs. European Commission

The Commission welcomes the judgment of the General Court that confirms that the decision adopted by the Commission in 2009 in Case COMP/37956 - Ronds à Béton became definitive vis-à-vis Lucchini.

 
Case C-598/17 - A-Fonds

The Commission welcomes the judgment, by which the Court of Justice ruled that EU law precludes a national court from assessing whether a “condition necessary for the attainment of the objective and functioning of an aid scheme” complies with the free movement of capital.

 
Case T-747/17 - Union des Ports de France - UPF vs. European Commission

The Commission welcomes the judgment which confirms the State aid analysis made by the Commission and the way it handled the cooperation procedure. The General Court confirmed that port authorities are carrying out economic activities and are thus subject to State aid rules. It also confirmed that a corporate tax exemption for ports is incompatible State aid which distorts competition in the internal market.

 
Case T-754/17 - Chambre de commerce et d'industrie métropolitaine Bretagne-Ouest (port de Brest) vs. European Commission

The Commission welcomes the judgment which confirms the State aid analysis made by the Commission and the way it handled the cooperation procedure. The General Court confirmed that port authorities are carrying out economic activities and are thus subject to State aid rules.
