The Commission takes note of the judgment by the General Court on a 2014 Commission State aid decision approving French public support in favour of Marseille Airport and of the airlines operating at that airport. The General Court found that Air France’s appeal against the decision was inadmissible, because Air France failed to show how the decision impacted them directly and individually.

The Commission takes note of the rulings of the General Court, with respect to four annulment actions against the Commission 2015 Decision in the Retail food packaging cartel case. These judgements uphold the contested decision with respect to all of the undertakings concerned, except for the fine relating to CCPL which was annulled. We will carefully study this judgment before deciding on any next steps.

The Commission takes note of the judgement by the Court of Justice, which dismisses the Commission’s appeal against the General Court’s judgment relating to the fine imposed on a company that would have facilitated a cartel. The Commission will carefully study the judgement.
The General Court has annulled the Commission decision on the Hungarian advertisement tax in its entirety. The Commission will carefully study the judgment.
• The Commission welcomes today’s judgments by the General Court, which upheld the Commission State aid decision of October 2014 concerning the Nürburgring racetrack in Germany. In its decision, the Commission had found that certain support measures in favour of the company owning the Nürburgring were incompatible with the internal market under EU State aid rules but that the subsequent sale of the racetrack did not involve aid to the buyer.
• Importantly, the General Court clarified under what circumstances third parties may challenge a Commission State aid decision before the General Court. The General Court also rejected the claim of both applicants that the Commission should have opened a formal investigation into their complaints that the buyer of the Nürburgring racetrack assets had received State aid.
