MoveS seminar (Croatia): Posting of workers in the context of free movement and coordination of social security and recent changes in the EU legislation

The EC-funded MoveS network (Free Movement and Social Security Coordination) organised a seminar in Zagreb (Croatia) on 25 October 2019.

The seminar was organised by MoveS in collaboration with its Croatian national expert, Ivana Vukorepa. MoveS is an EC-funded network of independent experts from 32 European countries coordinated by Eftheia and Deloitte.

Croatia is predominately a sending country. Hence, the presentation of novelties from a labour law (i.e. new amendments to the posting directive, Directive 2018/957 and Directive 2014/67 on the implementation of the enforcement directive) as well as social security coordination perspective are crucial. Special attention has been paid to the probative value of A1 certificates (based on recent case law and planned changes to EU coordination rules) and the duty of sincere cooperation between the issuing and the requesting institution.  It is important that competent authorities and institutions, as well as practicing lawyers are aware of recent case law as well as new rules, tools and cooperation procedures to avoid potential fraud, unfair practices or abuse, while at the same time not hampering free movement of workers and provision of services.
