Commission clears Viasat's acquisition of Inmarsat

The European Commission has approved unconditionally, under the EU Merger Regulation, the proposed acquisition of Inmarsat by Viasat. The Commission concluded that the merger would not raise competition concerns in the European Economic Area or any substantial part of it.

EVH v Commission

The Commission takes note of the judgments of the General Court dismissing a number of appeals brought against a 2019 Commission's decision. In its decision, the Commission approved, under the EU Merger Regulation, the acquisition of certain E.ON power generation assets by RWE.
In its judgments, the General Court fully upheld the Commission’s decision. Notably, it confirmed that the Commission was correct in assessing the different parts of the asset swap as two separate concentrations. Furthermore, the General Court found that the analytical framework applied by the Commission was sufficiently and adequately explained.

Commission clears acquisition of Activision Blizzard by Microsoft, subject to conditions

The European Commission has approved, under the EU Merger Regulation, the proposed acquisition of Activision Blizzard by Microsoft. The approval is conditional on full compliance with the commitments offered by Microsoft. The commitments fully address the competition concerns identified by the Commission and represent a significant improvement for cloud gaming as compared to the current situation.

 
Commission clears Hydro's acquisition of Alumetal

The European Commission has approved unconditionally, under the EU Merger Regulation, the proposed acquisition of Alumetal by Norsk Hydro. The Commission concluded that the merger would not raise competition concerns in the European Economic Area, notably for green aluminium foundry alloys.

The European Commission has approved unconditionally, under the EU Merger Regulation, the proposed acquisition of Photomath, Inc. by Google LLC. The Commission concluded that the transaction would raise no competition concerns in the European Economic Area .

 
American Airlines v Commission

The Commission takes note of the judgment of the Court of justice of the European Union upholding a 2020 judgment of the General Court. In its judgment, the General Court dismissed American Airlines’ action for annulment of a 2018 Commission decision. In its 2018 decision, the Commission awarded ‘Grandfathering rights’ (granting ownership of a slot on a permanent basis) to Delta Air Lines, pursuant to the commitments provided by American Airlines and US Airways to enable the Commission to declare their merger compatible with the internal market in 2013.
In its judgment, the Court fully upheld the Commission’s assessment and decision.

The European Commission has approved unconditionally, under the EU Merger Regulation, the acquisition of the nitrogen business of Borealis AG (‘Borealis NITRO') by AGROFERT Group. The Commission concluded that the transaction would raise no competition concerns in the European Economic Area.
