Case C-517/15 P AGC Glass Europe and Others vs. European Commission

The court dismissed AGC’s appeal. The judgment confirms the existing jurisprudence according to which the Hearing Officer's competence covers the issue of protecting the confidentiality of contested information, taking also into account the principles of legitimate expectations and equal treatment. The judgement also confirms the Commissions's general policy concerning the use of information provided by leniency applicants in non-confidential final decisions in antitrust cases. A meaningful public version of cartel decisions is an important element to give EU citizens the possibility to see how EU competition rules are applied by the Commission.
