The Commission takes note of the judgment by the Court of Justice in relation to a national reference from the Supreme Administrative Court in Finland in a case concerning the duration of an alleged infringement of Article 101(1) TFEU in a bid-rigging cartel in the sector of a tender for the construction of high-voltage power lines in Finland.
In the judgment, the Court of Justice clarifies the duration of an infringement of Article 101(1) TFEU in bid-rigging situations. In particular, it held that the infringement period lasted until the date of signature of the contract concluded between the bid-rigging company and the contracting party on the basis of previously submitted tender, provided that the contract determines all the essential aspects of the contract, including in particular the overall price to be paid.
