Protection des demandeurs d’asile, meilleur accès des étudiants, des chercheurs et des touristes à l'Union européenne (UE), renforcement de la législation contre la traite des êtres humains, coopération dans la lutte contre l’extrémisme violent: l’action menée par l’UE dans le domaine des affaires intérieures durant la période 2010-2014 s'étend à de nombreux domaines. Voici les principales avancées réalisées à ce jour durant le mandat de Cecilia Malmström, commissaire européenne chargée des affaires intérieures.
Migration, asile et frontières
Après plus de 13 ans de négociations, l’Europe s'est accordée sur un régime d’asile européen commun. Les nouvelles règles communes, adoptées en 2013 et actuellement mises en place dans tous les États membres, visent à garantir que les demandeurs d’asile sont traités de façon humaine et équitable dans l’UE, quel que soit le pays d'entrée. Les demandes d’asile similaires doivent être traitées de la même manière et aboutir aux mêmes résultats. L’Europe s'est dotée de règles modernespour déterminer qui peut bénéficier du statut de réfugié, établir des normes garantissant aux demandeurs d'asile l'accès à un interprète et à une aide juridique et limiter le délai accordé aux autorités pour traiter une demande. Les États membres sont également tenus de veiller à ce que les demandeurs d'asile reçoivent des soins médicaux et psychologiques et que les enfants aient accès à l'éducation. La commissaire Malmström a présenté en 2010 des propositions législatives sur les conditions d’accueil, les procédures d’asile et les conditions d'octroi du statut de réfugié, alors que les négociations étaient dans l'impasse depuis plusieurs années. Dans tous les domaine touchant à l’asile, les nouvelles règles constituent un progrès par rapport aux normes actuelles. Une fois appliquées, elles permettront à l'Europe d'offrir une meilleure protection aux personnes qui fuient les conflits et les persécutions et aux États membres de prendre leurs responsabilités.
Les troubles qui ont éclaté avec le printemps arabe, ainsi que les nombreuses tragédies survenues en Méditerranée, ont rappelé l’importance d'offrir davantage de moyens légaux de se rendre en Europedepuis l'étranger. Outre son action pour inciter les États membres à accueillir davantage de réfugiés et intensifier leurs efforts de recherche et de sauvetage en mer, la commissaire a présenté plusieurs textes législatifs sur la migration de la main-d’œuvre. Au printemps 2014, les États membres et le Parlement européen ont approuvé la directive sur les travailleurs saisonniers, qui harmonise les droits et les conditions d’entrée et de séjour des travailleurs se rendant dans l'UE pour occuper un emploi saisonnier. Les travailleurs saisonniers venus de pays extérieurs à l'UE apportent une contribution significative à l’économie européenne. Avec la nouvelle directive, ils bénéficieront d'un statut juridique sûr pendant toute la durée de leur séjour, régi par les mêmes règles que celles s'appliquant aux citoyens de l’UE en ce qui concerne le temps de travail, le salaire minimum, les congés et les jours fériés, ainsi que la sécurité et l’accès à un logement approprié. Il sera également plus facile pour eux de revenir d'une année sur l'autre.
En outre, pour conserver son avance en tant que centre d’innovation et d’excellence, l'Europe doit attirer les connaissances et les compétences du monde entier. Aujourd’hui, de plus en plus, les étudiants et les chercheurs étrangersspécialisés dans des domaines tels que l'ingénierie et la médecine choisissent d'étudier ailleurs que dans l'UE, découragés par les lourdeurs administratives d'un autre âge qui entourent les études et la recherche en Europe. Les règles pour obtenir un visa d'étudiant ou un titre de séjour sont souvent floues et complexes. La commissaire Malmström a donc proposé de limiter à 60 jours le délai accordé aux autorités nationales pour statuer sur une demande de visa, d'appliquer des procédures simplifiées et plus transparentes et d'adopter des règles plus simples et plus souples pour les déplacements dans l’UE. Les étudiants étrangers devraient être autorisés à travailler un minimum de 20 heures par semaine, afin de pouvoir subvenir à leurs besoins et de contribuer à l'économie, et à rester une année en Europe à l'issue de leurs études pour explorer les possibilités d'emploi et de création d'entreprise. Notre économie a tout intérêt à ce que l’UE soit plus ouverte aux talents et permette la circulation des connaissances et des idées.
Une autre directive a été adoptée par le Parlement européen en mai 2014, faisant suite aux propositions de Mme Malmström sur les «détachements intragroupe» d'experts étrangers. Actuellement, les entreprises cherchant à faire venir de l'étranger des membres importants de leur personnel sont confrontées aux règles et aux formalités administratives de 28 pays, ce qui rend extrêmement difficiles aussi bien l'entrée que les déplacements dans l'UE. Une fois que les nouvelles règles seront pleinement appliquées, les spécialistes et les cadres pourront séjourner et se déplacer en Europe pendant trois ans avec un seul permis. Ces experts étrangers contribuent à créer des emplois en renforçant la compétitivité de l'UE et en stimulant les investissements et les exportations.
Après un débat complexe engagé à la suite du rétablissement soudain des contrôles à la frontière entre la France et l'Italie en 2011, un accord important a été conclu sur le renforcement du système de Schengen. Cet accord établit des règles claires et transparentes pour la gestion des frontières européennes, afin de garantir la libre circulation des citoyens dans un espace sans frontière. En outre, il permet à la Commission de vérifier, au moyen de visites sur place, que les États membres respectent leurs obligations et n’effectuent pas de contrôles injustifiés aux frontières.
Les propositions législatives en matière de visasprésentées par la Commission européenne au printemps 2014 faciliteront à l'avenir les déplacements dans l'UE des ressortissants de pays hors UE. À l'heure actuelle, ces visiteurs sont souvent confrontés à des procédures compliquées et coûteuses. Les propositions législatives de la Commission vont permettre d'accélérer et de simplifier ces procédures, notamment en raccourcissant les délais d'octroi des visas, en renforçant la coopération entre les ambassades et les consulats et en facilitant les visites répétées. Selon une étude récente, au cours de l'année 2012, l'Union aurait «perdu» au total 6,6 millions de voyageurs potentiels, originaires de six des pays comptant le plus grand nombre de voyageurs, à cause de procédures de visa trop lourdes.
Pendant le mandat de Mme Malmström, l'obligation de visaa été supprimée pour cinq pays, dont le Brésil et la Moldavie: leurs ressortissants peuvent désormais se rendre dans l'UE sans visa pour des visites de courte durée. L'exemption de visa pourrait bientôt devenir réalitépour les citoyens de 19 autres pays, dont le Pérou, la Colombie et un certain nombre d'États insulaires. Des négociations sont également en cours avec la Géorgie, l'Ukraine et la Turquie. Des partenariats ont été conclus avec l'Arménie, l'Azerbaïdjan, le Maroc et la Tunisie, en vue d'améliorer la mobilité vers l’UE. Ces partenariats pour la mobilitévisent à renforcer les capacités des pays partenaires dans les domaines de l'asile et des migrations, mais aussi à lutter contre la traite des êtres humains et le trafic de migrants. Ils incluent des négociations sur l'immigration légale visant à aider certains groupes, comme les étudiants et les hommes d'affaires, à obtenir des visas, ainsi qu'à simplifier la reconnaissance des diplômes et des qualifications professionnelles.
Sécurité et lutte contre la criminalité organisée
Avant 2010, les règles régissant les poursuites dans les affaires de traite des êtres humains étaient très différentes d'un pays à l'autre de l'UE. Certains États membres manquaient de fermeté dans la répression et la protection des victimes. Une nouvelle législation européenne , proposée par la commissaire Malmström et adoptée par le Parlement européen et le Conseil, établit une définition commune de ces actes odieux, instaure des sanctions plus lourdes pour les trafiquants, prévoyant notamment des peines de prison minimales, et rend la protection et l'assistance aux victimes obligatoires pour les États membres. Cette définition commune inclut l’exploitation à des fins criminelles, le trafic d'organes, l’adoption illégale et le mariage forcé. Un plan d'action contre la traite des êtres humainsà l'échelle de l'UE, comprenant 40 actions concrètes pour s'attaquer aux causes du problème, a également été lancé. Les États membres mènent des enquêtes policières conjointes avec Europol, l'office européen de police, et travaillent en collaboration avec les pays hors UE et les délégations de l'UE. Un réseau européen a été créé pour mettre en relation les organisations et les autorités chargées de la protection des victimes. Des recherches sont en cours sur différentes problématiques, notamment le recrutement des victimes et le phénomène de re-victimisation dans le pays d’origine.
La corruption est l'une des activités criminelles les plus rentables et les plus dommageables. Dans son premier rapport sur la corruptiondans les États membres, la Commission évalue l'étendue du phénomène dans tous les pays de l’UE et analyse les mesures à prendre pour le combattre plus efficacement. Le rapport met en avant les bonnes pratiques et les solutions communes, afin d'encourager les autorités nationales à passer à l'action pour traiter ce problème, qui coûte chaque année à l’Europe 120 milliards d’euros — soit l'intégralité du budget annuel de l’UE. Les mesures proposées dans le rapport permettront aux États membres de renforcer la transparence en matière de financement des partis politiques, d'établir des mécanismes de contrôle au sein des autorités publiques, de garantir la divulgation des actifs en cas de risque de conflits d’intérêt, de renforcer les capacités des services répressifs, ainsi que d'améliorer la protection des personnes dénonçant des abus et la transparence des activités de lobbying. Le rapport préconise également de renforcer les normes d’intégrité dans le domaine des marchés publics et suggère des améliorations dans un certain nombre d'États membres. Un nouveau rapport anti-corruption sera publié tous les deux ans.
En ce qui concerne le terrorisme et l'extrémisme violent, une nouvelle législation a été adoptée, qui restreint l'accès aux produits chimiques pouvant servir à fabriquer des bombes. La commissaire Malmström a créé le réseau européen de sensibilisation à la radicalisation (RSR), qui réunit 800 professionnels (personnel des services répressifs, animateurs de jeunesse, chercheurs, etc.) de toute l'UE. Il vise à mettre en relation les experts du domaine, au niveau local et national, afin d'améliorer les échanges d’informations et d’expériences. Comment dissuader les jeunes de s'engager dans des mouvements extrémistes? Comment aider les autorités locales à mieux déceler les signes qu'un attentat terroriste est en préparation? En s'appuyant sur les travaux de ce réseau, la Commission a présenté en janvier 2014 une «boîte à outils» pour lutter contre l'extrémisme violent en Europe. Les actions proposées comprennent la mise en place de programmes de dé-radicalisation ou de sortie, offrant une assistance aux personnes désireuses de quitter ces groupes extrémistes. Par ailleurs, les services de police locaux devraient bénéficier de formations sur la manière de détecter les signes de radicalisation parmi les jeunes. L’UE va mettre en place un pôle européen de connaissance dans ce domaine, afin de mieux exploiter les connaissances et les expériences présentes dans tous les États membres.
Un accord sur l'utilisation des données des dossiers passagers (accord PNR), remplaçant un accord de 2007, a été conclu avec les États-Unis. En outre, l'UE et les États-Unis ont mis en place un programme de surveillance du financement du terrorisme (accord TFTP), qui remplace un accord intérimaire. Un accord sur les dossiers passagers a également été conclu avec le Canada et l'Australie. Les accords PNR et TFTP définissent des règles d'utilisation des dossiers passagers et des données financières dans le cadre de la lutte contre le terrorisme et contiennent des dispositions et des mécanismes de protection de l'intégrité pour le recueil et le stockage de données.
Ces dernières années, la cybercriminalité est devenue l'une des principales menaces pour notre sécurité. Afin de lutter contre ce phénomène, l'UE a adopté une nouvelle directive visant à combattre les attaques à grande échelle contre les systèmes d’information , ainsi qu'une stratégie européenne globale en matière de cybersécurité. Parallèlement, au siège d’Europol à La Haye, la commissaire Malmström a créé le Centre européen de lutte contre la cybercriminalité,ou «EC3», qui a pour mission de renforcer les moyens de défense de l'UE contre la criminalité organisée en ligne (fraudes, vols de données bancaires, attaques virales à des fins d'extorsion, etc.). Ces activités criminelles étant par définition sans frontière, la réponse ne peut être qu'européenne, et les services répressifs doivent s’efforcer de conserver une longueur d’avance. Concrètement, l'EC3 coordonne les enquêtes de police, recherche les cartes de crédit volées dans toute l'UE, bloque les tentatives d'intrusion dans les services bancaires en ligne, lance des alertes contre les nouvelles menaces et attaques de virus et met l'accent sur la répression des pédophiles sévissant sur internet. Il a permis de procéder à de nombreuses arrestations.
Dans le même domaine, une directive visant à lutter contre l'exploitation sexuelle des enfants, qui porte sur la poursuite des auteurs, la protection des victimes et les mesures de prévention, a été adoptée pendant le mandat de Mme Malmström. En outre, en 2012, les ministres de la justice et des représentants de 48 pays se sont réunis à Bruxelles afin de former une Alliance mondiale contre la pédopornographie sur internet. Quatre autres pays l'ont rejointe depuis lors. Créée à l’initiative de la commissaire européenne et du ministre américain de la justice, les pays composant l'Alliance (tous les États membres de l'UE et des pays aussi divers que les États-Unis, la Nouvelle-Zélande et le Cambodge) se sont engagés à renforcer les ressources afin d'identifier davantage de victimes figurant sur les photos et les vidéos en ligne exploitant des enfants. Les États participants doivent veiller à ce que les auteurs de ces crimes soient davantage traduits en justice et s'engagent à mieux informer le public au niveau national. Les membres de l'Alliance mondiale se sont également engagés, entre autres, à coopérer de façon systématique avec les services d'assistance aux victimes, à faciliter les enquêtes transfrontières et à adopter des lois interdisant aux auteurs de ces crimes de travailler avec des jeunes.
Dans le cadre de la lutte contre la criminalité organisée, la commissaire Malmström a entrepris une action au niveau de l’UE pour frapper les groupes mafieux au point le plus sensible: en s’attaquant à leurs profits. Grâce à la législation européenne sur la confiscation des avoirs d'origine criminelleadoptée en 2014 par le Conseil et le Parlement, il sera plus facile pour les services répressifs dans toute l'UE de procéder rapidement au gel d'avoirs détenus par des malfaiteurs lorsque les autorités judiciaires craignent que ces fonds disparaissent à l'étranger. Les auteurs d’infractions ne pourront plus transférer des actifs à des amis ou des parents en espérant ainsi les soustraire à la justice. Jusqu'à présent, les services répressifs avaient du mal à suivre ce type de transferts de fonds, car les règles régissant les poursuites dans ce domaine différaient d'un pays à l'autre et rendaient les procédures de confiscation complexes et inefficaces. Le commerce mondial de la drogue génère à lui seul près de 240 milliards d’euros de recettes chaque année, dont une petite fraction seulement est saisie par les autorités. En mettant de nouvelles règles en place, l’Europe s’emploie à faire en sorte que le crime ne paie pas.
