China’s institutional reforms and what it means for resolving IP disputes

Earlier this year, the China National Intellectual Property Administration (CNIPA) was moved from under the supervision of the State Administration of Market Regulation (SAMR) to a direct administration under the State Council to improve IP protection, management and enforcement. This article explores the impacts of this institutional change on the alternative dispute resolution mechanisms (ADR), which will now be improved with the creation of a One-Stop ADR platform for IP disputes under the CNIPA. The proposed mechanism is also expected to serve international IP disputes and could be used by the European SMEs.
