1. Introduction

This metadata information is provided by Lithuanian authorities to ensure compliance with the requirements of Articles 5 and 7 of Regulation 862/2007 on Community Statistics on Migration and International Protection.

As required by Article 9 of the Regulation 862/2007, Member States must report to Eurostat on the data sources used, the reasons for the selection of these sources and the effects of the selected data on the quality of the statistics. Member States shall provide it with all the information necessary to evaluate the quality, comparability and completeness of the statistical information.

The reference terms for the assessment of quality compliance are provided by Eurostat in the EIL technical guidelines (See section 3.4 Statistical concepts and definitions from the EIL ESMS file).

1. General aspects

The statistics collected under the Regulation 862/2007 are widely used in official publications and by a wide range of users at national, European and International level.

Main users of EIL statistics at national level
The EIL statistics produced are regularly used by national administrations: academic researchers and civil society groups working on a wide range of topics including the integration of immigrants, the development and monitoring of national asylum and immigration procedures, and the projection of the future population and labour force.

The main users are state and municipal institutions and agencies, business and research community, international organizations, the media.
 
Main users of EIL statistics at European and International level
The main users of EIL statistics are Eurostat, DG Home Affairs and EASO. The statistics are used in several publications of the Commission, as well as in the preparation of regular reports, policy proposals and analysis. The statistics also provide an input to the EMN studies and reports that address specific issues of current policy importance.

Classification of citizenship is based on the ISO-3166 code list (using alpha-2) with minor changes. These differences consist of minor changes that have occurred over time to reflect the creation of new countries or citizenships. In some cases, these citizenship categories are not universally recognised but are used by some Member States in the data supplied to Eurostat. Regulation (EC) no 562/2006 of the European parliament and of the council of 15 March 2006 establishing a Community Code on the rules governing the movement of persons across borders (Schengen Borders Code), Annex 5, Part B

Non-EU citizens found to be illegally present are Non-EU citizens who stay in the Republic of Lithuania for a period exceeding the time period established in Pragraphs 2-51, 7 of Article 11 of the Law on the Legal Status of Aliens (only in Lithuanian) of staying in the Republic of Lithuania without a visa, who stay in the Republic of Lithuania after the expiry of the validity of a visa or without a visa, if it is necessary, or are holders of an abolished visa or have no valid travel document, or who have a falsified travel document or a visa, also who entered the Republic of Lithuania illegaly and who live in the Republic of Lithuania without a residence permit or who have an invalid, withdrawn or falsified residence permit.

According to national law it is possibility to detect third-country nationals illegaly present in Lithuania but it is impossible to issue him/her an obligation to leave. For example it could be due to humanitarian aspects or because of marriage to a Lithuanian citizen. At the same time it is possible that some cases included in Y3 will not be shown in Y2. It covers cases, when the obligation to leave is issued in connection with negative asylum decision.
