Recycling data for materials such as wood, ferrous metals, aluminium, glass, paper and cardboard come from reports by PROs and self-complying entities to the Marshal of the Voivodship. PROs and self-complying entities are obliged to obtain documents that prove recycling from recycling operators. Recycling data for plastics comes directly from the reports of recycling operators to the Marshals of the Voivodship.

The main issue that can occur relates to errors during filling and submission of the reports on each level.

We suspect that some of the reusable packaging that circulates in closed loops may have been reported more than once, i.e. also after the first placing on the market. The matter will be further analysed in the context of improving data accuracy in future reports.

EPR organisations or producers are obliged to obtain documents that prove recycling from waste operators. These documents contain data from waste operators and later are used for administrative reporting to the marshals of the voivodeships. 18.4. Data validation

The Marshals of the voivodships verify the data in reports of entities.

18.4.1. Detailed description of the system for quality control and traceability for packaging waste pursuant to Article 6a(3) and (8) of Directive 94/62/EC

In accordance to the applicable law waste holders in order to issue a documents that prove recycling of packaging waste treated outside Poland must have an invoice or customs document that prove the movement of waste for recycling and the documents specified in Annex IA, IB or VII of Regulation (EC) No 1013/2006. Additionally waste holders organising packaging waste shippment encloses a statement that packaging waste will be recycled in installations that meet at least the requirements of installations operated in Poland.

Mass of packaging waste exported (export outside the EU) and intra-Community supply of packaging waste (export to another EU country) for recycling is determined on the basis of an EDPR document. The EDPR document is established on the basis of a customs document confirming the export of packaging waste outside the customs territory of the European Union for recycling, or on the basis of an invoice confirming the intra-Community supply of packaging waste for recycling and on the basis of a document on transboundary movements of waste as specified in Annex IA, IB or VII to Regulation (EC) No 1013/2006 of the European Parliament and of the Council of 14 June 2006 on shipments of waste.

The packaging waste exporter shall attach to the EDPR document a declaration that the packaging waste has been shipped in accordance with the provisions of Regulation (EC) No 1013/2006 and that it will be recycled in facilities meeting at least the requirements of facilities operated within the country. The exporter of packaging waste who draws up the EDPR document must have copies of documentation proving that the facility to which he exports packaging waste meets at least the requirements of the facilities operated in the country, and in particular that the operator of the facility holds a permit to recycle the exported waste, or an equivalent document issued by the competent authority of the country where the waste is treated.

Entrepreneurs referred to above who have drawn up EDPR documents confirming the export of packaging waste or the intra-Community supply of packaging waste exceeding 400 Mg are required to conduct an annual external audit. This audit is conducted by an accredited environmental verifier. The auditor shall provide the Voivodship Environmental Protection Inspector and the Marshall of the Voivodship with a certified copy of the audit report.

The Marshal of the Voivodship shall, at least once every 3 years, carry out an audit of entrepreneurs exporting packaging waste and making intra-Community deliveries of packaging waste.  If gross irregularities are found, as a result of the audit, he shall, by decision, invalidate the EDPR documents for which the information on packaging waste management contained in these documents has been shown to be inconsistent with the facts.

In accordance to the applicable law waste holders organising packaging waste shippment encloses a statement that packaging waste will be recycled in installations that meet at least the requirements of installations operated in Poland.
Exporters of packaging waste above 400 Mg, who issue the documents confirming recycling of packaging waste, are obliged to conduct an audit. Results of the audit are delivered to the Inspection and marshals of the voivodeships, which can further investigate any abnormalities.
