Rail - legislation in force in December 2009

Community legislation must lay the foundation for helping passengers to understand and exercise their rights. The single market for passenger rail transport is in the coming. First steps have been taken at national level. EU-wide cross-border rail passenger traffic will be opened to competition in 2010. In this situation the promotion of measures to safeguard the quality of rail services and users' rights are essential and the rail industry will benefit from a level playing field. Community legislation for Rail Passenger Rights will enter into force on 3 December 2009.

In principle, EU rail passenger right are applicable to all rail passenger services in all EU Member States. However, the Regulation gives the possibility for Member States to exempt certain types of services from the application of these rights.

National Enforcement Bodies (NEB) pdf - 110 KB [110 KB] have to guarantee the good application of Regulation 1371/2007 and passengers can lodge a complaint with them.
