Objective of Agreement To establish the general framework for the access of Community fleets to the waters of Mauritania.
Remarks The nature of the fisheries agreement concluded varies in terms of the partner country. With African and Indian Ocean countries and Greenland, which do not fully exploit their fishery resources, the Community pays a financial contribution for access to their fishing zones and establishes targeted actions with the partners with a view to supporting their fisheries sector and contributing to sustainable fisheries in their waters. A financial contribution is also required of vessel owners wishing to operate within the framework of these agreements. Bilateral fisheries agreements between the European Union and third countries establish the general framework for the access of Community fleets to the waters of these countries. A protocol attached to each lays down the specific conditions (technical, financial, type of resources, etc.) for implementation of the agreement. The agreement was applied on a provisional basis from 1 August 1996. It was preceded by another signed in 1987 expiring on 31 July 1996. Amended by an Agreement in the form of an exchange of letters (see OJ L 332/97, p.19) concluded by Council Regulation (EC) No 408/97 (OJ L 62/97, p.1), which refers to the fact that the Agreement was initially signed in 1996. The European Parliament withheld its approval and brought it to the Court of Justice of the European Communities on a question of principle (substantial financial commitment). However the Agreement continues to apply. The current Protocol covering the period from 1 August 2001 to 31 July 2006 is the fifth since the entry into force of the initial 1987 Framework Agreement. It was adopted by Council Regulation (EC) No 2528/2001 of 17 December 2001 (OJ L 341 of 22/12/2001). The Protocol provides fishing opportunities for demersal species, cephalopods, tuna and pelagic species.
