Summary of Treaty

GENERAL DATA
Official Title Agreement on mutual recognition in relation to conformity assessment, certificates and markings between the European Community and Australia - Final Act - Joint Declarations
Type of Agreement Bilateral
Place of Signature Canberra
Date of Signature 24/06/1998
Date of Entry Into Force 01/01/1999
Duration Indefinite
Objective of Agreement To facilitate trade in a range of regulated goods between Australia and the single market of the EC by means of mutual recognition in relation to conformity assessment.
Remarks For traded goods subject to mandatory technical regulations in an EC Member State, there is often a requirement for product to be tested and/or certified for compliance with regulatory requirements by a body located in the importing country. For many Australian exports to the EC, demonstrating compliance with EC regulations currently requires conformity assessment to be undertaken by a Notified Body located within the EC. Duplication of testing and certification for goods traded across national boundaries imposes significant additional costs on businesses The agreement will enable conformity assessment (ie testing, inspection and certification) of products intended for sale in the other party's territory to be undertaken in the country of origin. Removal of the requirement for assessment in the importing country has potential to reduce the costs incurred by exporters in demonstrating conformity of their products to EC requirements. It will apply to the following sectors: * pharmaceuticals (Good Manufacturing Practice); * medical devices; * telecommunications terminal equipment; * electromagnetic compatibility (EMC); * automotive products ; * simple pressure equipment; * machinery; * low voltage electrical equipment. The provisions of the agreement are consistent with the approach to conformity assessment taken in the World Trade Organization Agreement on Technical Barriers to Trade ('TBT Agreement'). Same type of agreement between the EC and New Zealand, Canada and the United States of America.
