Objectives of the consultation

This is an open consultation which aims to collect your views and background information. It intends to establish an impact assessment concerning the different options for EU action aimed to set up a mechanism for compliance checks and enforcement of Directive 2009/13/EC on all ships calling at ports of Member States, irrespective of their flag. The ultimate objective of the selected action will be the improvement of maritime safety, working conditions and the health and safety of seafarers.

The MLC contains provisions on the states' responsibilities - including flag states, port states and labour supplying countries - which could help meet the abovementioned objectives.

Against this background, we kindly ask you to evaluate the proposed measures, suggest modifications or even put forward alternative measures. The possible selected measures will be further evaluated in conjunction with maritime transport stakeholders.

We are in particular interested to hear what the main challenges, possibilities, or needs are, and to receive suggestions on how best to tackle them. In each section, you will find multiplechoice questions, but also space for expressing your own views and ideas.

Practical information

The consultation is being launched only in an electronic form via the interactive policy-making tool. Interested parties are invited to send their comments, suggestions and replies to the questionnaire to the Commission between 20 April 2011 (start date) and 14 June 2011 (closing date).

All citizens, organisations, public authorities interested or involved in Maritime transport and related services are welcome to respond to the public consultation. However, it was designed with persons in mind who have previous knowledge about these two topics. We would expect respondents to be familiar with the terminology used in the questionnaire.

Please note that the Commission will not respond individually to the contributions received.  The summary of the consultation's results will be published on the Commission's website. In addition, the results of consultations carried out in the Impact Assessment process will be summarised in the related reports.

This is an anonymous survey, and therefore, you are not obliged to give any personal details and the rules on personal data protection apply .

However, as there are numerous stakeholders on all maritime transport sectors, we ask you to indicate the sector within which you work, so that we can better use the answers.

If you are replying on behalf of an organisation, we also ask you voluntarily to indicate the exact name of the organisation, the department and the contact email. This information will not be made public or used for any other purpose than to facilitate this survey.

The questionnaire contains 18 questions, most of which being open-ended questions. Please be informed that if interrupted or left 90 minutes inactive, your contribution will not be saved. Even though the consultation is open during 8 weeks, we would encourage stakeholders to respond as soon as possible in order to help the ongoing impact assessment. Proposed practical steps for filling-in the questionnaire:

Questions are either compulsory or optional. If any of the compulsory fields have not been filled in, the system will not allow you to submit the questionnaire but will redirect you to the incomplete answer and give you an opportunity to correct it. An error message will appear in a purple/red colour under the question in which a problem occurred.

Please note that you should not use the ‘Back’ button in the upper left-hand corner of the screen of your browser to navigate the online questionnaire, because this will lead to a loss of all the data that you have already inserted. For navigation, you should use the buttons ‘Next’ and ‘Previous’ at the bottom of the questionnaire page instead.

When you successfully submit the questionnaire, a confirmation message will appear on your screen and you can print your answers.

Contributions may be submitted in any official EU language.

Contributions received in reply to the consultation will be used by the Commission services; the summary of the consultation's results will be published on the Commission's website. If you do not wish your contribution to be made public, please indicate this in your reply. In that case, your reply will also not be mentioned in future documents that may refer to this consultation.

If you are replying on behalf of an organisation, please state your name, address and official title in your reply. Any reply on behalf of an organisation which does not state the interests which it represents or the extent to which it is representative of the sector (number of members, size of organisation in relation to the sector to which its members belong) will be regarded as an individual reply and not a collective reply.
