Summary Report on the targeted consultation on the application of Article 17

In order to finalise the stakeholder dialogue on the application of Article 17 of the Directive on Copyirght and Related Rights in the Digital Single Market, the Commission organised a targeted consultation from 27 July to 10 September 2020. The consultation was addressed to the participants to the stakeholder dialogue organised by the Commisson pursuant to Article 17(10) of Directive (EU) 2019/790. The objective of the consultation was to gather feedback on the Commission’s initial ideas for the guidance that the Commission is required to issue on the application of Article 17.

 
Guidance on Article 17 of Directive 2019/790 on Copyright in the Digital Single Market

The aim of this guidance is to support a correct and coherent transposition of Article 17 across the Member States, paying particular attention to the need to balance fundamental rights and the use of exceptions and limitations, as required by Article 17(10). The guidance could also be of assistance to market players when complying with national legislations implementing Article 17.

 
Targeted consultation on the availability of works other than printed works in formats accessible for persons with disabilities within the internal market

The purpose of this targeted consultation is to collect information and data on the availability of certain copyright protected works, in particular works other than printed works (e.g.films, photos or music), to persons with disabilities. The Commission is carrying out this exercise as part of the preparation for a report foreseen by Article 9 of the ‘Marrakesh’ Directive (EU)2017/1564. The consultation is targeted at persons with disabilities and organisations acting on their behalf, rightholders, content producers, distributors, service providers, broadcasters and educational institutions.

 
Summary Report of the targeted consultation on the exercise of rights of performers and producers in the audiovisual sector

The targeted consultation on the exercise of rights of performers and producers in the audiovisual sector was held from 29 July to 31 December 2019. This consultation was addressed to those engaged in the management of rights in the audiovisual sector. The objective of the consultation was to gather relevant information and data on the exploitation of rights in the audiovisual market in relation to the term of protection. This summary report takes stock of the contributions and presents preliminary trends that emerge from them, focusing on the quantitative aspects of the input.

 
Authorised entities in the context of Directive (EU) 2017/1564

Under Article 6 of Directive (EU) 2017/1564 the Member States have an obligation to provide the Commission with the contact information they have received from authorised entities within the legal framework of Directive (EU) 2017/1564 on certain permitted uses of certain works and other subject matter protected by copyright and related rights for the benefit of persons who are blind, visually impaired or otherwise print-disabled.

 
Copyright: dialogue between platforms and rights holders starts on 15 October

The first meeting of the stakeholder dialogue on the application of Article 17 of the Directive on Copyright in the Digital Single Market on the use of protected content by online content-sharing service providers will take place on 15 October in Brussels. The stakeholders will discuss best practices on how content-sharing platforms and service providers should cooperate with rights holders.

Copyright: Commission launches dialogue between platforms and rights holders

The European Commission opened today a call for expression of interest to participate in the stakeholder dialogue on the application of Article 17 of the Directive on Copyright in the Digital Single Market on the use of protected content by online content-sharing service providers. The stakeholders will discuss best practices on how content-sharing platforms and service providers should cooperate with rights holders This dialogue is requested under the new directive and will feed into the preparation of guidance on the application of Article 17.
