The Commission takes note of the General Court's judgments, which support in substance the Commission's action aiming to ensure that a dominant telecom operator does not systematically hinder competitors that could have made a real difference in the market to the benefit of consumers and businesses. This also applies to companies that operate on regulated markets. In the circumstances of the present case (in which inter alia the regulatory framework acknowledges the need for alternative operators to have access to the incumbent’s infrastructure), the Commission is not required to prove that such access is indispensable for potential competitors to carry on their business, in order to demonstrate the abusive nature of the incumbent’s unfair conditions and delaying tactics. As regards the limited reduction of the relevant period of the margin squeeze and the fine reduction, the Commission will analyse the judgment in detail.
