Commission approves €1 billion Slovak State aid scheme to support investments in equipment necessary to foster the transition to a net-zero economy

The European Commission has approved a €1 billion Slovak scheme to support investments for the production of equipment necessary to foster the transition towards a net-zero economy, in line with the Green Deal Industrial Plan. The scheme was approved under the State aid Temporary Crisis and Transition Framework, adopted by the Commission on 9 March 2023 and amended on 20 November 2023, to support measures in sectors which are key to accelerate the green transition and reduce fuel dependencies.

Commission adopts new general rules for small amounts of State aid and for services of general economic interest

The European Commission has today adopted two regulations amending the general rules for small amounts of aid (de minimis Regulation) and for small amounts of aid for Services of General Economic interest, such as public transport and healthcare (SGEI de minimis Regulation). The revised regulations, which exempt small aid amounts from EU State aid control since they are deemed to have no impact on competition and trade in the Single Market, will enter into force on 1 January 2024 and will apply until 31 December 2030.

Commission approves €2.6 billion State aid to RWE for early closure of lignite-fired power plants in Germany

The European Commission has found a €2.6 billion German support measure in favour of RWE Power AG to be in line with EU State aid rules. The aid will compensate RWE for the early phase-out of its lignite-fired power plants in the Rhenish mining area.

Commission clears Novozymes and Chr. Hansen merger, subject to conditions

The European Commission has approved, under the EU Merger Regulation, the proposed merger between Novozymes A/S and Christian Hansen A/S. The approval is conditional upon full compliance with the commitments offered by the parties.

Commission publishes template for reporting on consumer profiling techniques under the Digital Markets Act

The European Commission published the template for reporting on consumer profiling techniques and the independent audit of such reports. Gatekeepers are obliged to submit the reports to the Commission as part of their obligations under Article 15 of the Digital Markets Act (DMA).

EDP España v Naturgy Energy Group and Commission

The Commission takes note of today’s judgment of the Court of Justice of the European Union annulling a 2021 judgment of the General Court upholding a State aid Commission decision of 27 November 2017. The Commission had opened a formal investigation procedure into Spain's so-called “environmental incentive”.
In its opening decision, the Commission had reached the preliminary conclusion that the environmental incentive constitutes State aid and had harboured doubts as to its compatibility under the applicable State aid rules. The Commission will carefully study the judgment and reflect on possible next steps.

Commission v Amazon.com and Others

The Commission takes note of today's judgment of the Court of Justice of the European Union confirming the 2021 judgment of the General Court which annulled the Commission’s 2017 decision. In its decision, the Commission had concluded that Luxembourg had granted selective tax advantages to Amazon constituting illegal State aid.
The Commission will carefully study the judgment and assess its implications.

Open calls for tender

Training of national judges in EU competition law and judicial cooperation between national competition law judges

The objective of this call for proposals is to co-finance projects aiming to train national judges in the context of enforcing European competition rules. This includes public and private enforcement of both the Antitrust rules and the State aid rules, thereby increasing the knowledge and know-how of national judges. The final aim is to ensure a coherent and consistent application of EU competition law by national courts.
