Spain: Access to social security for those with ongoing asylum appeals

Flag of Spain

Spain's Ministry of Inclusion, Social Security and Migration announced that applicants for international protection who have not yet been given a final decision on their case will not be withdrawn from the national social security system.

The decision follows numerous complaints highlighting the fact that asylum seekers - specifically, those who had received initial rejections but were in the process of appealing these - were being directly withdrawn from the social security system before a final decision on their case had been reached. This was the result of a six-year delay in the transposition into Spanish national law of an EU directive which sets out different processes for the reception of applicants for international protection, including in relation to their employment.

This decision means that thousands of families will now be able to continue living, working and accessing health care in Spain while their asylum appeals are pending.
