Summary

Council Regulation No. 1206/2001 has created a uniform European system of judicial cooperation for the purposes of taking cross-border evidence in civil and commercial matters. The Regulation establishes simple and rapid mechanisms between courts of the different Member States for the purpose of taking evidence.

    Sehr geehrte Damen und Herren! Die Beschleunigung von Verfahren liegt im Interesse aller Verfahrensbeteiligten. Daher sind entsprechende Maßnahmen auch in grenzüberschreitenden Fällen zu begrüßen. Wesentlich ist allerdings dabei, dass derartige Beschleunigungsmaßnahmen nicht zu einer Beeinträchtigung der Rechte der Beteiligten führen und die prozessuale Waffengleichheit der Parteien gewahrt bleibt.
