Notifications under Article 24(3) of the Tobacco Products Directive
According to Article 24(3) of the Tobacco Products Directive 2014/40/EU , a Member State may prohibit a certain category of tobacco or related products where such a prohibition is justified by the need to protect public health (taking due account of the high level of health protection already achieved by the Directive), and having regard to the specific situation in that Member State.
Such national provisions are to be notified to the Commission. Within six months of receipt of the notification, the Commission is to either approve or reject such provisions after having verified whether or not they are justified, necessary and proportionate and whether or not they constitute a disguised barrier to trade between Member States.
