8. Main Content
This draft is part of the implementation of the security measures necessary for the supply of mobile 5G services. It requires certain entities to ensure that the persons, equipment, software and data necessary for the real-time monitoring of their (elements of the core of the) 5G network and linked to the control of physical and logical access to their (elements of the core of the) 5G network are located in the territory of the European Union. Persons who do not supervise the network in real time, but who may be asked to carry out a specific act on the network, may be located outside the territory of the European Union, provided that their interventions are continuously monitored.

9. Brief Statement of Grounds
This draft Royal Decree implements Article 105(8)(2) and (3) of the Law of 13 June 2005 on electronic communications. It imposes the rules on MNOs, full MVNOs and certain operators of a private 5G network necessary for carrying out the activities absolutely essential for the operation, security and continuity of their network within the territory of the Member States of the European Union.
