The amendment to the Ordinance on Electronic Legal Transactions with the German Patent and Trade Mark Office (ERVDPMAV), envisaged by Article 2, intends to allow international applications via the filing system of the German Patent and Trade Mark Office (DPMA) to also be submitted in the form of signature-free electronic communications. Furthermore, the option of making international applications via the electronic filing system of the European Patent Office (EPO) is being worded so as to be technology neutral and it is being clarified that international applications can also be submitted to the DPMA using the electronic filing systems of the World Intellectual Property Organization (WIPO) intended for such applications. The envisaged new § 3(3) second sentence ERVDPMAV stipulates that, in addition to the underlying certificate, the electronic signature must be verifiable by the DPMA or by a body commissioned by the DPMA.

8. Main Content
According to the current § 3 ERVDPMAV, applications may be submitted either via the electronic receiving unit of the DPMA or using the electronic filing system of the EPO. The envisaged new § 2(1)(3) ERVDPMAV is intended to allow international applications to be submitted via the electronic filing system at the DPMA also in the form of signature-free electronic communications in the future. Signature-free submission is to take place via the DPMAdirektWeb filing platform. The obligation to use this input channel is to arise from § 3(1) ERVDPMAV, according to which documents are to be submitted exclusively to the electronic receiving unit of the German Patent and Trade Mark Office (DPMA), using the access and transmission software provided by the DPMA (or the epoline software of the European Patent Office pursuant to paragraph (4)). The second sentence of § 3(3) ERVDPMAV is intended to provide that not only the underlying certificate but also the electronic signature must be verifiable by the DPMA or a body commissioned by it. § 3(4) ERVDPMAV is to be worded so as to be technology neutral, since the EPO epoline filing software has been renamed eOLF and will be replaced in the medium term by two new web-based application channels. The new § 3(5) first sentence ERVDPMAV is also intended to specify, by way of clarification, that international applications can also be submitted to the DPMA using the WIPO electronic filing systems intended for these applications.


9. Brief Statement of Grounds
The amendments to the ERVDPMAV are intended to provide further options for the DPMA to receive electronic documents without signature that go beyond those currently available. The proposed new rules of the ERVDPMAV in particular simplify international patent applications to the DPMA by enabling signature-free electronic communication and allowing international applications to the DPMA also through the WIPO electronic filing systems intended for this. As a result, the procedural processes at the DPMA are expected to improve, leading to administrative streamlining. It is highly likely that the costs associated with scanning documents that have been submitted in hard copy will decrease in the long term. The verification of the electronic signature in accordance with the new § 3(3) second sentence ERVDPMAV serves to provide a complete security guarantee for applicants and the DPMA by also ensuring in the future that signed data is unfalsified.
