Main Content The proposed regulation grants research organisations, including their affiliated researchers, a right of access to certain data of the service providers concerned in conjunction with the forthcoming transposition of Article 17 of Directive (EU) 2019/790 on copyright in the Digital Single Market in the Act on the responsibility under copyright law of online content-sharing service providers, which serves to transpose this Article. The right relates to data concerning the use of procedures for the automated and non-automated recognition and blocking of copyright-protected content. The right is intended to enable researchers to gather findings on the nature of the measures taken by service providers to automatically recognise and block content, as well as the performance of algorithms used by service providers to do so. However, the proposed regulation does not authorise researchers to have direct technical access to databases or technical systems of the service provider. Interests of the service provider that are worthy of protection preclude the right of access if they outweigh the public interest in the research. The proposed regulation provides for the possibility for service providers to be reimbursed for reasonable costs incurred in granting access to data. 9. Brief Statement of Grounds Social media and, in particular, also corresponding service providers (upload platforms) are of increasing importance for the creative ecosystem and thus also for copyright law. The communication processes that take place there between and with the users of the services are of considerable importance for the use of creative content and, at the same time, also for the formation of public opinion. For this reason, there is a considerable public interest in creating more transparency on the functioning of the respective platforms and the process of content distribution there, as well as in enabling independent research findings on such. 10. Impact assessment Service providers are expected to incur annual costs of approximately EUR 74 000 for collecting and providing data to researchers. As the service providers can be reimbursed for a reasonable amount of the cost incurred in providing the data, this cost for service providers will ultimately be borne by the research organisations. 16.
