This Order defines the maximum plastic content permitted in single-use plastic cups as from 3 July 2021. The maximum permitted level shall be progressively lowered to a zero value from 1 January 2026.
As such, the Draft Order defines the concept of “maximum plastic content” allowed in cups. It sets a timetable for the reduction of the maximum plastic content in the cups. It provides for monitoring progress on alternative solutions to achieve zero value as of 1 January 2026. It introduces a time limit for disposal of stocks of 6 months of the cups manufactured or imported from the deadlines set.


9. Brief Statement of Grounds
The Draft Order notified is taken in the context of the application of Article 4 of Directive (EU) 2019/904 of 5 June 2019 on the reduction of the impact of certain plastic products on the environment. This Directive provides for the implementation of measures to reduce the consumption of certain single-use plastic products, in particular beverage cups, and specifies that such reduction measures may take the form of marketing restrictions targeted on these single-use plastic products.
A regulatory text previously notified in 2020 had transposed certain measures of this Directive (Decree No. 2020-1828 of 31 December 2020 on the prohibition of certain single-use plastic products). In particular, it lays down the conditions for the application of the ban on single-use plastic beverage cups on a trajectory to reduce the plastic content in these cups. This trajectory shall be specified by an Order, the subject of this notification. This measure to reduce the consumption of single-use plastic cups, in accordance with Article 4 of the above-mentioned Directive, pursues the objective of achieving the provision of plastic-free cups.
The provisions of this Order specify the conditions for the implementation of this trajectory to reduce the consumption of plastics in single-use cups. Achieving a complete reduction of plastic in cups requires a step-by-step approach, with deadlines between 2021 and 2026.

On 28 April 2021, France notified the EU Commission of a draft regulation on the maximum permissible plastic content in single-use plastic cups (notification 2021/260/F). The French draft order makes references to the Article 4 of Directive (EU) 2019/904 of the European Parliament and of the Council of 5 June 2019 on reducing the impact of certain plastic products on the environment (SUPD). 

We understand, given the general spirit of Law n ° 2020-105 of February 10, 2020 relating to the fight against waste and the circular economy that the reduction measures in decree n ° 2020-1828 applies to plastic cups intended to contain a drink for immediate consumption (a few minutes to a few hours at most), and not to pre-filled, sealed beverage cups (sales packaging or prepackaging as defined by EU Regulation 1169/2011), e.g. cups with cold coffee, buttermilk, drinking yogurt, etc. sold in supermarkets and other retail stores

However, the draft decree, as it stands, is nonetheless a source of great uncertainty for the Danish food and beverage sector as it potentially allows for a very broad definition of a cup, including containers containing drinks with a shelf-life for several weeks to several months, for which there is currently no alternative packaging without plastic or even with a plastic rate not exceeding 15% available on the market.

If the scope of the draft French decree is not clarified and explicitly excludes pre-filled, sealed beverage cups (sales packaging or prepackaging as defined by EU Regulation 1169/2011), it will be a clear barrier to trade on the internal market and will pose a direct threat to export from Denmark to France corresponding to an estimated three digit mill DKK amount over the next three years.

Also the environmental consequences of the French decree would be substantial due to the destruction of stocks of empty plastic cups intended for export to France.

We urgently ask for a clarification of the exact scope of the French draft order and for the conclusive saying that pre-filled, sealed packaging containing and preserving long-life drinks for a period of days to months in supermarkets and other retail stores is excluded from the scope of the decree.
