8. Main Content
This draft is part of the implementation of the necessary security measures for the supply of mobile 5G services. It establishes the restrictions on the use of the network elements or services of certain suppliers. Such restrictions were considered necessary as alternative measures that could be imposed are not sufficient to adequately mitigate the safety risk in question. The draft shall also specify the composition of the dossier to be submitted for the purpose of obtaining a ministerial authorisation. The draft also specifies the hypotheses in which an authorisation is necessary in the event of an update of software or hardware related to a network element.


9. Brief Statement of Grounds
This draft of the Royal Decree implements the Article 105 of the Law of 13 June 2005 on electronic communications as it will be replaced by the law introducing additional security measures for the provision of mobile 5G services (the draft law is notified at the same time). It lays down the necessary details to implement in practice the system of prior authorisation introduced by the law.
