Articles 4.5.1, 4.5.7, 4.5.8 and 4.5.9 may contain technical regulations. The amendments are as follows:

A
In Article 4.5.1, a definition for ‘thermal input at bivalent temperature’ is inserted.

B
In Article 4.5.7(2), the technical requirements set for biomass-fired boilers are amended. A woody-biomass-fired boiler meets standard EN 303-5 if the heat transfer in the boiler is to a liquid and if the boiler is not a pellet stove, wood stove, built-in fireplace or fireplace insert.

C
In Article 4.5.8(1), ‘thermal input’ is replaced with ‘thermal input at bivalent temperature’.

D
In Article 4.5.9(4), a new factor (the angle incidence modifier as per the European product data sheet) is introduced in the calculation method for the output.


9. Brief Statement of Grounds
The amendments in Parts A and C ensure that the subsidy for air-to-water heat pumps shall be based solely on the appliance's renewable thermal input. This is in line with the objective of the Sustainable Energy Investment Subsidy Scheme [Investeringssubsidie duurzame energie – ISDE], which is to encourage the purchase of small-scale installations for the generation of renewable heat. The subsidy shall no longer also be calculated on any peak input required for very low outside temperatures and generated by conventional energy.
The change in the definition of ‘thermal input at bivalent temperature’ links up with existing European legislation (Commission Delegated Regulation (EU) 811/2013). Here, it is stipulated that the thermal input shall be calculated at a temperature of between -7 and +2 degrees Celsius, as indicated on the product data sheet of the air-to-water heat pump. This amendment will result in a lower thermal input for some appliances, therefore reducing the amount of subsidy available to applicants for subsidies for air-to-water heat pumps with an additional non-renewable thermal input.

The amendment in Part B incorporates what are known as forced-air heating appliances into the biomass boiler category. Forced-air heating appliances are appliances that generate renewable heat and, unlike the biomass boilers already permitted, use air to transfer heat to the space being heated, instead of a liquid. In order to be eligible for the ISDE subsidy, forced-air heating appliances must meet the same conditions as the biomass boilers already permitted, with the exception of standard EN 303-5. This means that the strong emission requirements for biomass boilers will also apply to forced-air heating appliances, and that built-in fireplaces, fireplace inserts and open hearths will remain ineligible for the ISDE subsidy. Pellet stoves cannot be eligible for this category as they have their own separate category.

In Part D, a new factor (the angle incidence modifier as per the European product data sheet) is introduced in the calculation method for the output of solar water heaters with an aperture surface of over 10 m2. Introduction of the angle incidence modifier also requires changing the figure in the formula from 1 215 to 1 293 kWh. This change will help level the playing field between solar water heaters based on flat panel collectors and those based on vacuum tube collectors.
