Main Content The selected products to which the proposed legislation pertains are electrical and electronic equipment (EEE), batteries and accumulators, tyres and vehicles. The purpose of the new legislation is to establish comprehensive rules governing selected products throughout their life cycle, i.e. from production and placement on the market to treatment after these products (end-of-life products) have become waste. The subject of the provisions of the proposed Act is the regulation of the content of hazardous substances in selected products, prevention waste from selected products from being generated, regulated take-back or collection of end-of-life products with the goal of ensuring the greatest possible proportion of their reuse, and recycling and special rules for handling end-of-life products, including their utilisation and disposal. The proposed Act also consolidates and comprehensively legislates rules for the establishment and functioning of comprehensive systems for fulfilling the manufacturer’s obligations resulting from the manufacturer’s expanded responsibility. Brief Statement of Grounds The key objective of the draft Act is to ensure a high standard of protection of the environment and human health from the adverse impacts of waste from selected products, in accordance with the relevant legislation of the EU. The issue of end-of-life products is currently regulated by Act No 185/2001 on waste and amendments to certain other acts, as amended (the ‘Waste Act’). The Waste Act is the fundamental piece of legislation which has governed the waste economy in the Czech Republic since 2001. It has been amended many times, primarily due to the necessity of transposing the applicable directives of the European Union. Over the course of time, the Waste Act became quite complex and confusing due to frequent amendments. For that reason, it is necessary to create new, separate legislation. The issue of end-of-life products in many respects eludes the systematisation of the basic waste regime (in particular the expanded responsibility of the manufacturer, take-back, etc.). Another practical reason is the fact that EU directives concerning end-of-life products are amended very frequently and the entire Waste Act would have to be amended each time in order to transpose them. The draft also transposes the obligations resulting from the circular economy package for the first time, among other things. 10. Reference Documents - Basic Texts No basic text(s) available 11. ETRMA (European Tyre and Rubber Manufactures Association) has been aware about the new draft act on selected end of life products through the public notification procedure.
We have assessed in detail the proposed legal act and we have to say that the transposition of the waste framework directive in respect to end of life tyres has been positively covered by the act.
We warmly welcome specific articles to deal with some topics e.g. On how tyre producers, distributors, and the last seller have to transmit in a separate line on the invoice the costs of take-back used tyres as the best way of generating awareness on the consumer about the environmental cost of the waste management. Even the obligation of holders, on request of the customs office, to demonstrate that tyres intended to be exported, within any consignment, are not really waste, as a measure of prevention of the dumping of waste in thirds countries.
Therefore, European Tyre Industry, fully support the transposition text of the WFD into the Czech Republic´s legislative acquis.
