- The draft decree contains, inter alia, updates to the Ministerial Decree of 22 July 2005 to Regulation (EU) No 1169/2011 and Commission Implementing Regulation (EU) No 828/2014.


8. Main Content
The draft has an effect on the Ministerial Decree of 22 July 2005 by way of:

- changes or additions to Articles 1 to 9 of the ingredients of products that can use protected designations (Panettone, Pandoro, Colomba, Savoiardo, Amaretto and Amaretto morbido, special and enriched products), labelling and the mutual recognition clause;

- the addition of two new articles, Articles 8a and 9a, on exemptions for products specifically made for persons intolerant to gluten, as well as sanctions therefor;

- additions to Annex I on the calculation of percentages;

- deferral of the effectiveness of the new provisions until the ninetieth day following its publication in the Official Gazette of the Italian Republic.


9. Brief Statement of Grounds
In implementation of Law No 350/2003, the Ministerial Decree of 22 July 2005 has regulated the production of some of the most well-known traditional Italian confectionery products in order to protect their national status in the interest of both the industry and the consumer.
The method used was that of outlining the production method and qualitative features for each product by means of a scrupulous examination of the Italian production scheme and existing legal regulations at an EU level.
In particular, ‘Panettone’, ‘Pandoro’ and ‘Colomba’, so-called holiday cakes (for Christmas and Easter), along with ‘Savoiardo’ and ‘Amaretto’, have had a specific identification card detailing their definition, composition, labelling rules and technological processes since 1 August 2005.
With the entry into force of this legislation, the dual result of ensuring the transparency and fairness of the market as well as that of guaranteeing the protection of and accurate information to the consumer has been achieved with respect to a category of highly consumed products.
In light of experience gained, problems encountered and clarifications expressed by this Administration with interpretative circulars, it was deemed necessary to make some corrections to the aforementioned decree nearly 10 years after its publication in order to provide a framework for operational certainty in line with the spirit of the standard, which is shared by all but in certain cases not yet fully understood.
