8. Main Content
The reason for submitting this implementing decree on requirements for foods for which advertising is permitted and which can be offered for sale and sold in schools and educational establishments is the need to curtail the unhealthy environment in schools and school facilities that causes obesity. The implementing decree identifies requirements for foods (including beverages) that can be offered for sale and sold in schools and educational establishments. Only foods whose nutritional composition complies with the principles of healthy nutrition will be authorised for sale in schools and educational establishments. These are foods that do not contain caffeine or trans-fatty acids from partially hydrogenated fats, and are not energy drinks or stimulating beverages.

In schools and educational establishments, it will be possible to offer for sale and sell fruit, vegetables, and fruit and vegetable juice without added sugar. If the limit for salt, sugar or fat, and the minimum content of the original ingredient in a food specified in the implementing decree is met, it will also be possible to offer for sale and sell the following in schools and educational establishments: processed fruit and vegetables, dairy products, baked goods, non-fried meat products, egg products, fishery and aquaculture products, and oily seeds and legumes. Sandwich-type bakery products sold in schools shall not include mayonnaise, dressings, mustard or ketchup.

This implementing decree does not apply to food served in school cafeterias, which is regulated by different legislation.


9. Brief Statement of Grounds
In order to effectively prevent chronic nutrition-related diseases, it is proposed to restrict the promotion, offer and sale of foods containing ingredients whose excessive daily intake is inappropriate; these are primarily fats, saturated fatty acids, simple sugars and salt.
Act No 82/2015, amending Act No 561/2004 on preschool, basic, secondary, higher vocational and other education (the Education Act), as amended, added a strict requirement to § 32(2), pursuant to which ‘the advertising and sale of products endangering the health, psychological and moral development of children, pupils and students’ is prohibited in schools and educational establishments. At the same time, the Ministry of Education, Youth and Sports, in cooperation with the Ministry of Health, was authorised to stipulate key requirements in an implementing decree for foods for which advertising is permitted and which can be offered for sale in schools and educational establishments. The draft implementing decree fulfils the authorisation of the Education Act.
