    Justification for Article 7.4:

    Hearing-aid audiologists producing and modifying hearing aids as prescribed by a specialist medical practitioner. They conduct these tasks in a way that is compliant with the relevant provisions of health law and welfare law.

    Chimney sweepers and the health crafts carry out activities that harbour significant potential risks. It is for this reason that the German federal statutory law, i.e. the Crafts Code, sets out provisions dealing exclusively with these crafts and setting out higher standards for the provision of services in these crafts.

    Art. 7 para. 4 of the Directive prohibits the examination prior to the provision of services where automatic recognition under Chapter III of Title III applies (Art. 16 et seq.).  Professions pursuant to Annex IV of the Directive are subject to automatic recognition under Chapter III of Title III. Certain crafts are among the professions enumerated under Annex IV.

    Annex IV, however, does not list are craft professions. Chimney sweepers and the health crafts  have not been listed in Annex IV and therefore are not privileged by automatic recognition pursuant to the Directive. Since these crafts have public health or safety implications (see above), the competent authorities may continue to check the professional qualification of the service provider.

    Annex IV group 39 deals with “Miscellaneous manufacturing industries”, while crafts carry out non-industrial activities. Therefore one cannot argue that Annex IV no. 392 („Manufacture of … equipment and orthopaedic appliances (except orthopaedic footwear)“  applies to orthopaedic technicians. It is for the same reason that no. 393 („Manufacture of … optical equipment“) does not relate to opticians. The other health crafts (hearing-aid audiologists, orthopaedic shoemakers and dental technicians) and chimney sweepers are clearly not listed in Annex IV at all.

    Annex IV relates to classifications of industrial sectors that date back to the year 1964. These classifications were established for statistical purposes and are not suitable for the German crafts. The respective regulated activity of the German craft is much wider than the activities listed in Annex IV no. 392 and no. 393. The health crafts adjust medical appliances and carry out examinations. All health crafts are entirely subject Art. 7 para. 4 of the Directive.

    Annex IV simply adopted the annexes of the previous transitional directives. The transitional directive 64/427/EEC previously applied to crafts. It was adopted by Appendix IV List 1 of the Directive. Annex IV adopts the previous classification of NACE as a classification of industrial sectors. This approach is not only outdated, but it is also difficult to relate certain professions to the industries listed in Annex IV.

    Description of activities:

    Selbstständige Ausübung des Hörgeräteakustiker-Handwerks als stehendes Gewerbe. Die Ausübung des Handwerks setzt nur voraus, dass der (technische) Betriebsleiter für das Handwerk oder für ein verwandtes Handwerk qualifiziert ist (§ 7 Abs. 1 S. 1 HwO). Eine vergleichbare Qualifikation ist auch für die Ausbildung erforderlich. Herstellung und Änderung von Hörsystemen nach fachärztlicher Verordnung unter Berücksichtigung gesundheitsrechtlicher und sozialrechtlicher Vorschriften. Hierbei ist nur der Kernbereich der Tätigkeit erfasst, nicht so genannte einfache Tätigkeiten, z. B. solche, die innerhalb von drei Monaten erlernt werden können.

    Independent work as a non-travelling hearing-aid audiologist. This craft can be exercised provided that the (technical) branch manager has obtained the qualifications prescribed for the exercise of this craft or a related craft (Article 7 (1), p.1 of the German Crafts Code (HwO)). Anyone wishing to provide vocational training in this craft must have comparable qualifications. Producing and modifying hearing aids as prescribed by a specialist medical practitioner, and conducting these tasks in a way that is compliant with the relevant provisions of health law and welfare law. Restrictions only apply to the core duties of the occupation, not to what are defined as simple tasks, such as tasks that can be mastered after up to three months of training.
