  Description of activities:

  Įmonės restruktūrizavimo administratorius (toliau – restruktūrizavimo administratorius) tai teismo paskirtas atlikti įmonės restruktūrizavimo procedūras fizinis ar juridinis asmuo, turintis teisę teikti įmonių restruktūrizavimo administravimo paslaugas ir šią teisę įgijęs įstatymo ir su jo įgyvendinimu susijusių teisės aktų nustatyta tvarka.

  • Imasi priemonių, kad teismo nustatytais terminais būtų parengtas, pateiktas tvirtinti ir įgyvendintas restruktūrizavimo planas;

  • Rengia rašytinę išvadą dėl restruktūrizavimo plano projekto įgyvendinimo galimybių ir ją pateikia įmonės valdymo organui;

  • Prižiūri restruktūrizuojamos įmonės valdymo organų veiklą, susijusią su restruktūrizavimo plano vykdymu.

  • Restruktūrizavimo administratorius atlieka savo pareigas pagal su įmone sudarytą atlygintinų paslaugų teikimo sutartį, kurią įmonės vardu pasirašo įmonės valdymo organas.

  Administrator of enterprise restructuring (hereinafter referred to as the “restructuring administrator“) a natural or legal person appointed by the court and having the right to provide enterprise restructuring administration services who has acquired such a right pursuant to law and other legal acts relating to the implementation thereof.

  • Takes measures to draft, submit for approval and implement a restructuring plan within the time limits set by the court.

  • Prepares a written conclusion on the feasibility of the draft restructuring plan and submits it to the management body of the enterprise.

  • Supervises the activities of the management bodies of the enterprise under restructuring relating to the implementation of the restructuring plan.

  • A restructuring administrator performs his duties under a contract for services provided against payment concluded with an enterprise, signed on behalf of the enterprise by the management body of the enterprise.
