The situation as regards raw milk cheeses (whereby they are banned for import into Korea unless they have been matured for a minimum of 60 days) remains unchanged. It was previously the case that all raw milk cheeses were banned for import into Korea, however the Korean health experts visited production plants in the EU on the invitation of the European Commission and now hard raw milk cheeses (such as Parmigiano - Reggiano) can be exported from the EU. In terms of registration of plants, EU exporters must register with the Korean MFDS. The current procedure for registering establishments does not violate the terms of the SPS chapter, but it nevertheless lacks clarity and transparency and therefore goes against the spirit of the FTA itself.

The hurdle to become "Licensed Exporter" and to benefit from FTA is to high. To much efforts and burocracy. We have invested in a new branch office and sales organization in Korea and see a very good future in this - only the "Licensed Exporter" is a big, big issue for us. Please cancel this 6.000€ border and give it free - you wil have much more know how flowing to Korea as well as create new employment within Korea. Without the mentioned barriers we will easily employ more people.

In Austria trade surplus shrank: in 2010 it amounted 233 m € bevor EU-Korea FTA. In 2012 it reduced to 215 m € and in 2015 it sank eventually to only 133 m €. This happend due to the fact that imports rose faster than exports to Austria. This unfavourable tendecy most probabely sustains for 2016 (data from the STAT cube. Statistics Austria). The tradebalance for the EU sunk as well from 7,3 bn in 2015 to 2,6 bn in 2016 (source: Commission. Report on the 6th EU-Korea FTA Trade Committee, dated 16th of Dec 2016). Which represents a decrease of 66 %! It shows that FTAs open markets but not coercively fosters overall welfare in the EU.

The Chair of the EU DAG Georgi Stoev complains in a letter of the EU Domestic Advisory Groupe to Trade commissioner Malmström dated December 16th 2016 about the serious and widespread violations of the right to freedom of association and to bargain collectively in south Korea. In practice the deregistration and dissolution of the Korean Teachers Union, the refusal to register the Korean Government Employees Union, the mass dismissal and jailing of members of the Koran Railway Union and the illegal raid on the headquaters of the Korean Confederation of Trade Unions remain the main problems. DAG and CSF contributed intensivly to the solution of the existig problems, but the necessary transmission to the Committee on Trade and Sustainable Develpment and effective mearures are missing.

In the above mentioned letter of the EU Domestic Advisory Groupe it says: "No EU-Korea Civil Society Forum is to be held in 2016 due to complications from the Korean government." The EU-DAG and the Civil Society Forum seem to be very activ concerning the problems of ratification, implementation and the effective application of the right to freedom of association and to bargain collectively in Korea. But to our knowledge the korean government has refused to get into formal consultations with the EU via the Committee on Trade and Sustainable Development (CTSD) so far. To date Korea has not yet ratified 4 of these 8 ILO Core Labour conventions and there are no signs from the government to make any efforts to change that situation.

As mentioned, the EU should ask for the insertion of a regulatory cooperation clause. Korea should not be able to implement further additional technical requirements, by asking for a third party mandatory certification without consulting the EU. EU should encourage Korea to strengthen their market surveillance mechanism, which will truly enhance the working and production processes in Korea.

An improved market access for European goods. A better coordination and cooperation among EU and Korean civil society organisations, within the Framework of activities related with the implementation of the Chapter on Trade and Sustainable Development.
Non-ratification of the fundamental ILO Conventions and the actions against certain trade unions organisations, had a negative impact on the country's image among European civil society. Unfortunately it has come to this situation, even though the Korean government committed itself to achieve some progress in this regard, not only due to assumed obligations as member of OECD, but also as signatory party of the EU-Korea FTA. A modern and developed state as Korea inspires many nations, however the Korean Government should take care that this image would not be replaced by the label of a country where the forced labour is tolerated and rights as freedom of association and collective bargaining are not respected. Contrary to the opinion of Korean authorities, the non-ratification of fundamental ILO Conventions not only affects the image of the country in relation to other trade unions and human rights organisations in the world, but it creates the necessary conditions for some governments and companies in the EU to invoke clauses of unfair competition in the implementation of the Free Trade Agreement.

The operations done in the EU (e.g. sorting, sieving, cleaning, grading) are not sufficient to obtain the EU preferential origin. Rough diamonds are not mined in the EU, which means they never obtain EU preferential origin. Polished diamonds can obtain EU preferential origin if they have been cut and polished in the EU. This is only the case for a small part of the goods, as the majority of the diamonds are polished in low-wage countries (e.g. India). The EU, and Belgium at its heart, is the largest trading place for rough and polished diamonds in the world. Stringent RoO however affect our competitiveness. We would appreciate having a discussion with the European Commission to see how the FTA can be modified in order to either alleviate the RoO for diamonds (e.g. allowing sorting and grading to be sufficient to obtain EU preferential origin) or to allow diamonds exported from the EU to benefit from the tariff reductions of the FTA (0%), even though the goods don't have the preferential origin. We strongly believe that in this case both the EU and Korea would benefit from such an approach. Korea for example doesn't have a local polishing industry, so there's no disruption of the internal market. They do have jewelry manufacturers however, who would clearly benefit from lower prices as a result of the abolition of the 5% import tax. Allowing European diamonds to compete in a free and fair way with diamonds exported by India would also benefit the Korean jewelry industry: diversity of supply will increase and prices will decline.
