2.1. Data description

2.1.1. Introduction

This metadata information is provided by national authorities to ensure compliance with the requirements of Article 6 of Regulation 862/2007 on Community Statistics on Migration and International Protection.

As required by Article 9 of the Regulation 862/2007, Member States must report to Eurostat on the data sources used, the reasons for the selection of these sources and the effects of the selected data on the quality of the statistics. Member States shall provide it with all the information necessary to evaluate the quality, comparability and completeness of the statistical information.

The reference terms for the assessment of quality compliance are provided by Eurostat in the Residence permit statistics technical guidelines applied for 2015 reference period (See section 3.4 Statistical concepts and definitions from the Residence permits statistics ESMS file).

 

2.1.2. General description of the statistical domain at national level

National system for compilation of residence permits statistics (level of development, main changes that affected the system in the last years and further development)

The United Kingdom has no established residence permits register and there is no data source that captures information on the legal status of migrants who are UK residents. The UK therefore produces an estimate for residence permits.  The Home Office data on passenger arrivals, visas, extensions and asylum processes is used to compile data for the UK's equivalent systems (RP1 to RP6). 
 
The data in table RP7 for the UK are estimates made using a combination of population data (from the 2011 Census and Annual Population Survey) and other data sources to provide the best available estimates of the population of non-EU nationals by individual countries having long-term legal resident status in the UK. The methodology for the current 2015 calendar year data supply consisted of adjusting the 2014 data to provide data for 2015. For 2015 data estimates were obtained from the 2011 Census for England and Wales by nationality and year of arrival. These were then adjusted to produce estimates of the UK long term legally resident population based on year of arrival and research on the legally resident population. 2015 data were estimated from making adjustments to the 2014 data. The population of non-EU nationals who became resident in the UK in 2010 (according to data from the 2011 England and Wales Census scaled to UK totals) were added to the 2014 estimates. Using data from the International Passenger Survey, non-EU nationals emigrating in 2014 who had been in the UK for more than five years were removed. Finally long-term resident non-EU nationals who had died in 2014 needed to be removed from the estimates. Deaths registrations data in the UK do not record the nationality of the deceased individual; therefore country of birth was used as an approximation of nationality.

 In accordance with Article 6 statistics relating to residence permits must be supplied to Eurostat within six months of the end of the reference year.  Residence permits data are not published on a national level in the UK.

2.1.5. General procedure for issuing first residence permits at National level

The UK does not issue residence permits so provides an estimation.  Since the UK does not publish information on residence permits the information provided is mainly based on passengers given leave to enter the United Kingdom in selected categories (via Landing cards). The Home Office data on passenger arrivals, visas, extensions and  asylum processes is used to compile data for the UK's equivalent systems (RP1 to RP6).

 Data exclude all EU nationals, EEA nationals, and nationals from Switzerland.  Figures exclude dependants, renewals and those who entered the UK in another capacity and subsequently switch.  Since 2012 length of valid permission and nationality are available due to improvements in the UK visa data.  These have been provided by pro rataing based on visa issuance data.

 

2.1.6. General procedure for recording change of status or reason to stay of the permit (reason)

During the process of granting leave, caseworkers normally complete the previous immigration category field on the Case Information Database. This field is used to produce the  change of status or reason to stay of the permit analysis.

The Office for National Statistics provides data (for RP7) based on census and other survey sources.  The data in table RP7 for the UK are estimates made using a combination of population data (from the 2011 Census and Annual Population Survey) and other data sources to provide the best available estimates of the population of non-EU nationals by individual countries having long-term legal resident status in the UK. The statistics collected under the Regulation 862/2007 are widely used in official publications and by a wide range of users at national, European and International level. The Residence permits statistics produced are regularly used by national administrations, academic researchers and civil society groups working on a wide range of topics including the integration of immigrants, the development and monitoring of national asylum and immigration procedures, and the projection of the future population and labour force.

At European level, the main users of Residence permits statistics are Eurostat and DG Migration and Home Affairs. These statistics are used in several publications of the Commission, as well as in the preparation of regular reports, policy proposals and analysis.  The statistics also provide an input to the European Migration Network (EMN) studies and reports that address specific issues of current policy importance.

As the UK does not have residence permits estimates of the data are provided. This means the data is not directly comparable to other MS.   The UK does not provide data on single permits, the EU blue card, or seasonal workers as it is not part of these directives.  The UK does not provide details on permits for human trafficking as this is not recorded on landing cards so no estimation can be made.  For unaccompanied minors only data is only available for asylum seeking unaccompanied minors.

RP7 is not a subset of RP6.  This is due to differences in definitions (for example following our previously approved HO methods/meta data, RP1 to RP6 do not include those who do not need any permit as they have permanent status) and different data sources used (RP1 to RP6 based on administrative data, RP7 based on Census/population estimates).

"Highly skilled workers" are those who come through the Tier 1 route which  is for “high-value” migrants who contribute to growth and productivity. This tier currently consists of the Investor, Entrepreneur, Graduate Entrepreneur and Exceptional Talent routes.

The asylum statistics include re applications and dependants.  The residence permits data are divided into main applicants and dependants and main applicants only, and don't include re applications.  

In addition, we don't technically have data on numbers of asylum seekers with valid leave to remain as we don’t know the actual length of grants given. Therefore the residence permits figures provided to Eurostat are an approximation, based on the standard length for each grant type.
