1. Introduction
This metadata information is provided by Slovakian authorities to ensure compliance with the requirements of Articles 5 and 7 of Regulation 862/2007 on Community Statistics on Migration and International Protection.
As required by Article 9 of the Regulation 862/2007, Member States must report to Eurostat on the data sources used, the reasons for the selection of these sources and the effects of the selected data on the quality of the statistics. Member States shall provide it with all the information necessary to evaluate the quality, comparability and completeness of the statistical information. The reference terms for the assessment of quality compliance are provided by Eurostat in the EIL technical guidelines applied for 2014 reference period (See section 3.4 Statistical concepts and definitions from the EIL ESMS file).


2. General description of the statistical domain at national level
EIL National System (level of development, main changes that affected the system in the last years and further development)
For the purpose of production of EIL statistics, we use national Information system of illegal migration and international protection "MIGRA" (hereinafter referred to as "MIGRA IS"). In order to improve the quality of information on irregular migration we have developed this new MIGRA IS. The system was put into operation in 2010. MIGRA IS is the basic source of information regarding illegal migration in the SR, which are used in the production of statistical outputs on a national and European level and also in the development of analytical products. MIGRA IS underwent development several times in order to produce statistical reports required for processing EIL statistics. The system is capable of producing output for the correct filling in of all EIL tables, including voluntary EIL tables on returns.

3.3. Data collection

National systematic process of gathering data for official statistics.

It has been developed a new information system on migration and international protection (hereinafter referred to as "MIGRA IS") in order to improve the quality of information on illegal migration and asylum procedures and thereby for providing statistical information at national and European level and also in the development of analytical products. Project was carried out in 2009-2010 using EU funds and it is a common system of Bureau of Border and Alien Police of Presidium of the Police Forces (BBAP) with the Migration Office of Ministry of Interior (MU). The system was launched in 2010.

MIGRA IS:

  • is used to record proceedings and acts in dealing with foreigners at the border, inland and also in dealing with asylum procedures,
  • provides comprehensive data,
  • is the basic source of information regarding illegal migration in the SR and thereby for  statistics and analyses processed at regional and central level,
  • provides statistical information on migration for national as well as European  institutions and agencies (EUROSTAT, Frontex),
  • provides information for analytical work at all levels (tactical, operational, strategic)
  • its integration into the AFIS and EURODAC ensuring unambiguous identification of persons based on fingerprints (This functionality is crucial when the illegal migrant has been in the territory of the Slovak Republic in past or is an asylum applicant in any other member state of the European Union, or wants to hide his/her true identity),
  • is user friendly (searching, sorting and summarizing information according to various criteria is clear and transparent) and made available to police officers of the BBAP at all three levels (Access to the system is possible also for other police units).

This information system is an important analytical tool because it collects the amount of data of apprehended illegal migrants at the border or inland, refusals of entry and asylum applicants and furthermore the running of all operations that are performed with these migrants by the BBAP and MU. By integrating all data into a single information system, information on illegal migration and international protection are more transparent, unified and comprehensive. They are also very useful for the production of statistics on illegal migration and international protection at both national and European level.

Information and data are regularly (daily) entered into MIGRA IS by police officers of police unit of BBAP (Users responsible for input). It's always the police unit, which carries out the case of an illegal migration (so they know all relevant information about the case). The data are entered into MIGRA IS either manually (filling of predefined items – personal information, information about the case) or electronically (taking a picture, taking of fingerprints, scanned documents such as: the records of the interview of migrant, the copies of travel or other documents and evidence, the expulsion decision, the decision on detention, etc..). Information entered into the MIGRA IS are available immediately for police officers of the BBAP at all three levels.

Users responsible for input must learn “Methodology for using MIGRA IS”. Methodology is internal document of BBAP and includes all information necessary for work with the system and procedures for entering all relevant and correct data into MIGRA IS. Users responsible for input must complete the training regarding MIGRA IS at least once per year, which is performed by police officers at central level - specialists in statistics and analysis of illegal migration and specialists in technical matters when working with MIGRA IS.

The data entered into MIGRA IS are checked by two-step control (on a regional level and then on a central level) on a daily basis in terms of correctness, quality, accuracy and complexity of input data. Check of data at both levels is performed by the analytical units. Furthermore analytical unit at central level (RAU) correct detected errors and provide methodological guidance (by phone, email) to users responsible for input. These measures are almost eliminated errors in the data entered into MIGRA IS. RAU in addition to the checks and methodical guidance is responsible for implementing EIL statistics. RAU defined the reports from the system to fill the EIL individual tables. The definitions of these reports may be updated based on the requirements of Eurostat (new subdivisions, new voluntary tables), or new reports can be defined. The report format is electronic (.csv or .xlsx).

Some of the defined reports are exclusively used for specifically EIL table and some reports are used for compiling more data sets (national statistics, European statistics and Frontex statistics). It is almost export database, which enables data filtering and create contingency tables.

When defining or modifying reports or to add new items to the application of the MIGRA IS, it is based on the current needs and practices arising from national legislation and also of European legislation and requirements of the European agencies (particularly Eurostat and Frontex). Since external provider realizes these modifications of the MIGRA IS system, implementation is influenced by the considerable financial and time aspect. Police officers – experts in the field of statistics, analysis and IT in frame of BBAP together with an external provider cooperate in defining and specifying reports (organize meetings, discuss about the details of specification of the individual reports, etc.). The purpose is to ensure that the MIGRA IS have such data collection and the various outputs, which allow to create different correct and precise statistics, with different breakdowns and definitions both at national and European level.

3.4. Data validation

Description of the data validation system at national level

Statistical department of BBAP directly performs regular second level checks of all data inputs into the system in terms of correctness, accuracy and complexity of input data. This department also compares the data input into the system with daily reports gathered for other purposes (operational management and organisation activity). It has the competency to correct detected errors; it notices users responsible for input and methodologically manages the procedures for accurate and correct input of data into the system. Logical checks of statistical outputs from this system are performed. 

There are checks of data uploaded to IS MIGRA at the national level being done in the end of each month. Later on statistical data are taken from this data source. Functionality and accuracy of statistical outputs from IS MIGRA are monitored continuously. The checks of the data are aimed to eliminate all registered defects made during the data uploading for specific month. Statistical outputs are regularly checked. Outputs for month, quarter, half of year and year are being checked and compared with monthly outputs. Defects are identified and individually corrected.

1. Description of the Quality management system at national level

Information system MIGRA is the administrative source of data provided to Eurostat according to articles 4, 5 and 7. It is a mutual system for both BBAP and Migration Bureau of Ministry of Interior (hereinafter referred to "MB MOI"). User (police officers) inputs the data according to articles 5 and 7. These users with access rights are bound by general legislative norms and acts, which guarantees the relevancy and objectivity of input data. The two level check system is implemented. At first level - data input is checked at regional level. Statistical department of BBAP directly performs regular second level checks of all data inputs into the system in terms of correctness, accuracy and complexity of input data. This department also compares the data input into the system with daily reports gathered for other purposes (operational management and organisation activity). It has the competency to correct detected errors; it notices users responsible for input and methodologically manages the procedures for accurate and correct input of data into the system. Logical checks of statistical outputs from this system are performed. This output is processed into individual statistical tables while strictly observing the most recent Eurostat methodology (Technical guidelines to the new EIL templates - article 5 and 7) and according to the individual statistics methodology created at the department. The Working procedure methodology for the generation of individual statistics at the department has been created during the first processing of statistics for reference year 2008 and is continually being updated (it is an internal working document). It is based on the correct selection of input from administrative sources and integrating input into individual tables in order to meet the definitions and most recent instructions of Eurostat.

5.1. Relevance - User Needs

1. General aspects

The statistics collected under the Regulation 862/2007 are widely used in official publications and by a wide range of users at national, European and International level.

Main users of EIL statistics at national level

Concepts, definitions and classifications of European statistics on migration are not used at the national level. At the national level, the concepts used arise from national legislation and current needs of practice. Other and different terms and definitions are used for the purposes of statistics required by agency Frontex. Administrative data sources in all of these cases are the same (MIGRA IS), but the definitions, scope and disaggregation of the European statistics, national statistics and Frontex statistics are different.

Main users of EIL statistics at European and International level
The main users of EIL statistics are Eurostat, DG Home Affairs and EASO. The statistics are used in several publications of the Commission, as well as in the preparation of regular reports, policy proposals and analysis. The statistics also provide an input to the EMN studies and reports that address specific issues of current policy importance.

 

2. EIL data publication at national level

Presentation of the EIL statistics published at national level

We do not publish European statistics; however, they are sent to other users on request, for example for the processing needs of European migration network (EMN) studies etc.

Except of that we publish our own national statistics on migration and international protection of foreigners in our country. In the case of UHCP, there are processed annually and semi-annual basic reports on legal and irregular migration of foreigners and are published on the website of the Ministry of Interior (URL link:http://www.minv.sk/?annual-reports-2005-2015). Reports are extensive (about 80 pages) and contain a number of statistics on legal and illegal migration in the various breakdowns. The accompanying definitions are matter of course. Other statistics are processed for internal service purposes in the framework of the Ministry of Interior and are available on the Intranet site of UHCP (monthly, quarterly, semi-annual, annual, cumulative, etc.). These statistics are also provided to other entities on request (public authorities, intergovernmental institutions, legal persons and individuals).

Differences between the data provided to Eurostat and the data published at national level (Comparability of figures)

Concepts, definitions and classifications of European statistics on migration are not used at the national level. At the national level, the concepts used arise from national legislation and current needs of practice. Other and different terms and definitions are used for the purposes of statistics required by agency Frontex. Administrative data sources in all of these cases are the same (MIGRA IS), but the definitions, scope and disaggregation of the European statistics, national statistics and Frontex statistics are different.

There are more appointed officers, who (independently on each other) process statistical outputs in order to fulfil relevant statistical templates according to actual EIL technical guidelines and according to Methodology for production of EIL statistical reports.  The methodology for production of EIL statistical reports at the department has been created during the first processing of EIL statistics for reference year 2008 and is continually being updated (it is an internal working document). It is based on the correct selection of input from administrative sources (MIGRA IS) and integrating input into individual tables in order to meet the definitions and most recent Technical guidelines of Eurostat.

Statistical outputs for EIL data are produced in line with article 5 and 7 of Regulation 862/2007 on Community Statistics on Migration and International Protection. We are using actual Technical Guidelines for the data collection under art. 5 and 7 of Regulation 862/2007 for filling out EIL data and verification of required level of data quality.

 

2. Details on categories of Non-EU citizens difficult to be classified using the reference definitions from EIL technical guidelines and the categories excluded from these reasons (excluded from the statistics reported)

There is no issue regarding classification of Non-EU citizens difficult to be classified.

 

3. Description of records related to "Unknown" country of citizenship category

We register the cases of „Unknown" country of citizenship exceptionally only. These are the cases of apprehended foreigner who do not have any document and refuse to indicate their nationality. And their nationality is not possible to find out later as well.

If the foreigner  presents a travel document which shows that he/she is stateless, into the system is registered as  stateless person.

6. Establishing the reported ground in case of “multiple grounds” for the same refusal and the impact on double counting of the person in the same dataset

At national level (system) it is applied the methodological procedure of "one ground per refused person", as laid down in EIL Technical Guidelines (procedure of "higher” ground overrules the “lower” ground for refusal). There is no impact on double counting.

In our national statistics we use classification of reasons for refusal of entry according to the Annex V, part B of Regulation of European parliament and Council (ES) 562/2006, Schengen Border Codex. The Reason of refusal „H" is further divided into reason „H1" and „H2" in national statistics.

"H1"– is used for the person to whom an alert notification was issued in SIS (Schengen information system) because of refusal of entry,

"H2" – is used for the person to whom an alert notification was issued in states evidence because of refusal of entry

For statistical purposes related to EIL Y1 are the reasons „H1" and „H2" reported as reason H for refusal of entry „

 

10. The definition of “Non-EU citizens found to be illegally present” applied

When filling up statistical data to EIL Y2 templates, we follow the definition in article 5.1. b) of Regulation 862/2007 and actual instructions from Eurostat. Concepts, definitions and classifications of European statistics on migration are not used at the national level in full. The terms used at the national level arisen from national legislation and current needs of practice. Administrative sources of data for European statistics and national statistics are the same (MIGRA IS); however, definitions, scope and breakdowns of European statistics and national statistics are different.

We have not the common definition of TCN staying illegally in the territory of the Slovak republic for data collection at national level. TCN staying in the territory of the Slovak republic are divided into two groups: TCN apprehended for purpose of illegal border crossing and TCN apprehended staying illegally in the territory of the Slovak republic (inland). This breakdown is made for practical reasons and current needs of practice at national level.

Definitions for statistical data collected at national level are as follows: 

a) illegal state border crossing (further as „ISBS“) – external border (land border, airports), this category includes all foreigners who illegally crossed or attempted to cross illegally the external border of the Slovak republic, regardless of direction of crossing and were apprehended in the territory of the Slovak republic or in the territory of other country and subsequently returned to the territory of Slovak republic according to readmission agreement.

b) illegal stay at the territory of the SR – (further as "ILS") this category includes all foreigners who were found in the territory of the Slovak republic, in violation of the applicable legislation, which laid down the conditions for residence in territory of the Slovak republic, regardless the fact whether the foreigner had entered the territory of the Slovak republic legally or illegally (including ILS detected on at the border crossing point on exit from the Slovak republic.

To find out a number of "Non-EU citizens found to be illegally present”, both categories are added together and then the number of TCNs who attempted to enter the Slovak republic territory illegally at the border crossing point and were refused to entry the Slovak republic territory are counted out (this cases are included in category "refused Non-EU citizens” ). 

Of course subsequently are excluded duplications and other adjustments are made to the data in order to correctly completing the table EIL Y2 in accordance with the Technical guidelines.

 

11. The definition of “Non-EU citizens ordered to leave” applied

Third-country nationals found to be illegally present in the territory of Slovakia who are subject to an administrative or judicial decision or act, issued within the reference period (regardless to date of apprehension), stating or declaring that their stay is illegal and imposing an obligation to leave Slovakia.

 

12. The definition of “Non-EU citizens returned following an order to leave” applied

Third-country nationals found to be illegally present in the territory of Slovakia who were subject to an administrative or judicial decision or act, stating or declaring that their stay is illegal and imposing an obligation to leave the territory of the Member State, and who are recorded as having left the territory of Slovakia.

1. Links between the statistics on refused Non-EU citizens and the statistics on Non-EU citizens found to be illegally present.

Connection between statistics in EIL Y1 (refusals) and statistics in EIL Y2 (found to be illegally present) is that TCN´s listed in EIL Y 1 are not listed in EIL Y2. These are cases of attempts to cross the border illegally – external border (land border and airports) at the border crossing point in direction to the Slovak republic. These TCN´s did not enter the Slovak Republic territory because of refusal of entry at the border crossing point, so that they can´t be staying illegally in the territory of the Slovak Republic.

 

2. Links between the statistics on Non-EU citizens found to be illegally present and the statistics on Non-EU citizens with obligation to leave.

Decisions about expulsion were issued to TCN´s because of their illegal entry or stay in the territory of the Slovak Republic. The data reported in EIL Y3 data template contains data about number of TCN´s who were issued by administrative/judicial decision about expulsion during reference period with no relevance to the date of their apprehension for illegal stay. The main criteria for template EIL Y3 filling is that the date of obligation to leave the territory of the Slovak Republic provided by administrative or judicial decision about expulsion has to fall to reference period.

Some of asylum applicants are included in EIL statistics, in case that these applicants have been found to be illegally present in the territory of Slovakia. Asylum statistics are managed by Migration Office of Ministry of Interior.

For the reference year 2014, we have also provided additional voluntary disaggregation to the statistics on third-country nationals who have actually left the EU territory (where voluntary returned Non-EU citizens are included). 

Links between the EIL statistics and Asylum statistics and details related to the asylum applicant(s) case(s) included in EIL statistics.

Data in EIL Y3.1 – Non-EU citizens with obligation to leave the territory of country contains data about Non-EU citizens who the administrative / court decision on obligation to leave was issued during the reference period without relevance to the date of their apprehension for illegal stay in the territory of the Slovak republic.

Data in EIL Y3.2 – Non-EU cizizens who actually left the territory according to the administrative/court decision on obligation to leave contains all Non-EU citizens who left the territory of the SR during the reference period regardless the date of issuance of these decisions. Majority of Non-EU citizens who actually left the territory are from the group (set) Non-EU citizens with obligation to leave the territory of country.

 

2. Links and differences between the Non-EU citizens who actually left the territory and Non-EU citizens who left the territory to a third country

Data on Non-EU citizens returned to third countries are based on data on Non-EU citizens who left the territory of the Slovak republic on a basis of administrative/court decision about expulsion. Those Non-EU citizens are excluded, who were returned to EU countries, so the data Non-EU citizens returned to third countries include only the data which relates to TCN´s who were subject of expulsion to third countries.

Presentation of the available quality management - documentation

Quality assurance policy is not defined in a separate document but is being complied with. Quality assurance policy arise from the need to process quality data for registration, statistical and analytic purposes (on national and European level). This is a result of national legislation and fulfilling the commitments of SR to EU and Schengen. There are also personnel (employee responsibilities), technical (within systems for registration) and legislative measures. The quality of statistical processes and outputs is ensured by Methodologies, User manuals,  other internal regulations related to the operation of information systems and regular checks of the data and outputs. Commitment to quality is expressed publishing the Code of Practice in Slovak and English language on the Ministry of Interior of the SR website (http://www.minv.sk/?annual-reports-2005-2015).
