1. Introduction This metadata information is provided by Germanys authorities to ensure compliance with the requirements of Articles 5 and 7 of Regulation 862/2007 on Community Statistics on Migration and International Protection. As required by Article 9 of the Regulation 862/2007, Member States must report to Eurostat on the data sources used, the reasons for the selection of these sources and the effects of the selected data on the quality of the statistics. Member States shall provide it with all the information necessary to evaluate the quality, comparability and completeness of the statistical information. The reference terms for the assessment of quality compliance are provided by Eurostat in the EIL technical guidelines applied for 2014 reference period (See section 3.4 Statistical concepts and definitions from the EIL ESMS file).
2. General description of the statistical domain at national level EIL National System (level of development, main changes that affected the system in the last years and further development) The national system of Germany for the generation of the EIL-statistics is divided into three different authorities in the area of the responsibility of the Federal Ministry of the Interior; one authority takes over the reunification of the data on behalf of Federal Ministry of the Interior. This system is unchanged since introduction of the EIL-statistics. Changes (e.g. administrative structure, legal changes) that had an impact on the system in the past and could have in the future are unknown. Data (Third country nationals found to be illegally present) are based on the figures of the Police Crime Statistics (PCS). The PCS is an “outgoing statistics”, i. e. the criminal offenses that come to light are not recorded until the police investigations have been concluded and the respective files can be handed over to the public prosecutor's office or the court. Statistical evaluations (Third country nationals ordered to leave) are realized with the software program „COGNOS“ on a data warehouse technology. In the last years there were no substantial changes regarding this technology. Only software updates were conducted. Statistics on refusals and returns are part of the statistics of the Federal Police and the Federal Office for Migration and Refugees (BAMF) and German Federated States (Länder).
Legal national framework relevant for EIL statistics Third country nationals refused at the border: In 2013, there were changes in the Residence Act, concerning an entry by a fraudulently obtained visa, by threats, bribes or by incorrect or incomplete information visa administratively without permission. These individuals may be refused entry at the border. Third country nationals found to be illegaly present: The PCS catalogue used for recording criminal offences is based on substantive penal law provisions and represents to a large extent, and partly in a structure following criminological criteria, the provisions laid down in the Penal Code (PC) and in numerous special laws, e. g. the National Residence Act relating to the EIL statistics. Third country nationals ordered to leave: Statistical evaluations are based on the Act on the Central Register of Foreigners and the legal ordinance to this act.
Institutional infrastructure (list of the institutions involved in managing the EIL registers and the institutions involved in the production of the EIL statistics) Third country nationals ordered to leave: Federal Ministry of the Interior Federal Criminal Police Office (BKA) Federal Office for Migration and Refugees (BAMF) and German Länder Federal Police (BPOL) The Bundeskriminalamt (BKA; Federal Criminal Police Office) collates the relevant PCS data on the basis of the single datasets provided by the police authorities of the German Länder and the Bundespolizei (Federal Police). General procedure for recording Non-EU citizens refused entry at the external borders Refused people are statistically recorded (grounds for refusal) by the prescribed procedures of the Schengen Borders Code at the external borders. The data are summarized by the Federal Police.
General procedure for recording Non-EU citizens found to be illegally present The Bundeskriminalamt (BKA; Federal Criminal Police Office) collates the relevant PCS data on the basis of the single datasets provided by the police authorities of the German Länder and the Bundespolizei (Federal Police). All authorities are therefore involved in the procedure of the EIL statistics. According to the process described above relevant data is collected and provided for the criminal offences unauthorized entry (border crossing) (sect. 95 (1) no. 3, and (2) no. 1a Residence Act), and unauthorized stay (sect. 95 (1) no. 1, 2, and (2) no. 1b Residence Act). General procedure for recording Non-EU citizens ordered to leave In general the foreigner authorities save data in the Central Register of Foreigners if they receive information about the exit of a person.
General procedure for recording Non-EU citizens returned following an order to leave The data are collected by the Federal Police at the borders at the time of leaving the German territory by the third-country nationals. In addition to these data, numbers of voluntarily returnees are also collected in this statistic (source: Federal Office for Migration and Refugees and German Länder).
