3.1. Data description

Regulation (EC) No 223/2009 of the European Parliament and of the Council on Community statistics on European statistics, which was ratified in March 2009, is applicable to the European Statistical System (ESS), and has been adopted as a regulation pursuant to the Norwegian Statistics Act.

The regulation on European statistics forms the legal framework for the development, preparation and dissemination of European statistics. The regulation is also referred to as the European "Statistics Act", and regulates the cooperation in the ESS.

Norway is a member of the ESS through the EEA agreement. The regulation of the European Parliament and of the Council on Community statistics on European statistics was incorporated into Annex XXI of the EEA agreement in December 2009. The regulation was also established in Norwegian law as a regulation pursuant to the Norwegian Statistics Act.

This metadata information is provided by the authorities of Norway to ensure compliance with the requirements of Article 4.4 (Dublin statistics) of Regulation (EU) 2020/851 Amending Regulation (EC) 862/2007 on Migration and International Protection.

As required by Article 9 of the Regulation (EU) 2020/851 Amending Regulation (EC) No 862/2007, Member States must report to Eurostat on the data sources used, the reasons for the selection of these sources and the effects of the selected data on the quality of the statistics. Member States shall provide Eurostat with all the information necessary to evaluate the quality, comparability and completeness of the statistical information.

The reference document used for assessing the compliance of the concepts and definitions in this metadata file is the document Dublin statistics - Eurostat Technical guidelines to Dublin statistics (see Annex).

The data contain information on:

  • The number of requests for taking back or taking charge of an asylum seeker or a third-country national.
  • The provisions on which the requests for taking back or taking charge are based.
  • The decisions taken in response to the requests for taking back or taking charge.
  • The number of unilateral decisions taken by Member States to examine the application of an asylum seeker
  • The numbers of transfers to which the decisions taken in response to the requests for taking back or taking charge lead.
  • The number of requests for information and responses on such requests.

The data collection is entirely based on register data.

 

Legal national framework relevant for Dublin statistics

Lov om utlendingers adgang til riket og deres opphold her (utlendingsloven)/ Forskrift om utlendingers adgang til riket og deres opphold her (utlendingsforskriften).

Act of 15 May 2008 on the entry of foreign nationals into The Kingdom of Norway and their stay in the realm and their stay here (Immigration Act) /Regulations of 15 October 2009 on the entry of foreign nationals into the Kingdom of Norway and their stay in the realm (Immigration Regulations).

3.2. Classification system

ISO 3166 is the International Standard for country codes and codes for their subdivisions. Therefore the classification of Dublin data for reporting (GEO) and partner countries (PARTNER) is based on ISO-3166 (using alpha-2) with minor changes.

For any non-international concepts/breakdowns, classifications are based on Eurostat standards, e.g.:

3.4. Statistical concepts and definitions

Member States shall examine the application of any third country national who applies for asylum at the border or in their territory of any one of them.
The application shall be examined by a single Member State, which shall be the one which the criteria set out in Chapter III of Regulation (EC) 604/2013 indicates is responsible.
Under certain circumstances, each Member State may examine an application for asylum lodged by a third-country national even if such examination is not its responsability according to the criteria laid down in Regulation (EC) 604/2013.
In such cases, this Member State shall become the Member State responsible for the examination of the application.
The Member State conducting a procedure for determining the Member State responsible or the Member State which has been requested to take charge of or to take back the applicant shall inform the Member State previously responsible.

3.5. Statistical unit

The text of Art.4 of Regulation (EC) 862/2007 on Migration and international protection refers in general to statistics based on the number of persons and not on the number of applications. However, the article describing the 'Dublin' statistics (Art.4.4) refers to statistics based on the number of requests. Commission services recommend that Art.4.4 (more precisely 4.4.a, 4.4.c and 4.4.d) is interpreted as referring to the number of persons concerned by each request, decision and transfer.

The statistics collected under Regulation (EC) 862/2007 are used by a wide range of users at national, European and International level to cover various usersʼ needs.

 

Users of Dublin statistics : User categories are the general public and media organisations. The main interest is to compare the national situation with the situation within the whole Dublin system.

Unmet user needs (on statistics) and reasons why these needs cannot be satisfied (at national and international level) : Citizenship information would increase user satisfaction.

Administrative data from Asylum and Dublin processing collected by The Norwegian Directorate of Immigration (UDI). Processing is done in a Knowledge Guided Case Managment System where Eurodac and DublinNet communication is integrated. All administrative events are accessible from the Reporting Database which is the foundation of this statistics.
