Reporting is realised according to art. 3 - 5 from Decision 2005/270, as modified.

Reporting obligations for companies regarding packaging placed on the market as well as packaging waste management are established by national legislation - Law no. 249/2015  on packaging and packaging waste management, with its subsequent changes, and Ministerial Order 794/2012 on the reporting procedure for packaging and packaging waste.

All packaging placed on the market and all packaging waste generated in a country are covered, whether it is used or released at industrial, commercial, office, shop, service, household or any other level, regardless of the packaging material used.

  • The quantity of repaired wood packaging is not taken into account.
  • The quantity of metallic packaging waste resulted after incineration is not taken into account.

According to the reporting obligations, companies report information only for packaging waste generated in the reference year. Quantities stored at the end of the previous year and recycled in the reference year are not taken into account.

  • producers and importers of packaging intended to be filled at the point of sale, producers/importers of packed products, as well as those that overpack packed products, that act individually for their objectives achievement;  
  • companies that are authorised for taking over the responsibilities of annual recycling and recovery targets for packaging waste (PROs);
  • local public administration report waste packaging quantities that are separate collected / sorted from municipal waste by the sanitation companies;
  • permitted waste collectors; 
  • companies permitted for packaging waste recycling.

According to the national legislation, all companies that place packaging on the market are obliged to report, however free riders exist, even if the number of reporting units increased in the last years. In case of composite packaging, there is possible that the quantity is not correctly allocated by material type. Regarding waste treatment, the main issues that could affect data accuracy are: wrong waste code assignation, no legal obligation to comply with the recycling standards, no studies and guidelines.

18.1. Source data

Reporting obligations for companies regarding packaging placed on the market as well as packaging waste management are established by national legislation - Law no. 249/2015  on packaging and packaging waste management, with its subsequent changes, and Ministerial Order 794/2012 on the reporting procedure for packaging and packaging waste. According to the mentioned legal provisions, reporting obligations belong to:

  • producers and importers of packaging intended to be filled at the point of sale, producers/importers of packed products, as well as those that overpack packed products, that act individually for their objectives achievement:

a) data regarding quantities of packaging intended to be filled at the point of sale manufactured / imported put on the national market;
b) data regarding quantities of packaging used for packing products put on the national market;
c) quantities of packaging waste collected, recycled, recovered.

  • companies permitted for waste collection, recycling or recovery of packaging waste, packaging waste dealers and sanitation companies that collect packaging waste.local public administration report waste packaging quantities that are separate collected / sorted from municipal waste by the sanitation companies.
  • The above mentioned companies report on an annual basis to the County Environmental Protection Agencies (EPAs). EPAs perform primary data validation.
  • companies that are authorised for taking over the responsibilities of annual recycling and recovery targets for packaging waste (PROs):

a) total packaging waste for which contracts have been signed and managed quantities of packaging waste;
b) packaging waste for which responsibility was taken over from each responsible producer.

The companies that are authorised for taking over the responsibilities report the above mentioned data on an annual basis, to NEPA.

NEPA performs final data validation and compilation of all received information and prepares the report to be sent to EUROSTAT.

Companies permitted for packaging waste collection and treatment are obliged to report on an annual basis, according to the requirements from the national legislation. There is also a reporting obligation for PROs and self-compliers related to the packaging waste quantities collected and recovered - these data is used for validation of the data reported by waste management companies.

There is no statistical survey. There is a legal obligation for all companies that place on the market packaging and packed goods and also for the companies that collect and treat packaging waste to report certain information on an annual basis.

18.6.2. Attribution of waste to packaging and non-packaging types and correction for humidity

Description, where applicable, of the methodology to exclude non-packaging waste from the reported amount of recycled packaging waste and of the methodology to correct the amount of packaging waste at the measurement point in order to reflect the natural humidity rate of packaging (including by using relevant European standards). Aggregated data across facilities of a similar type is acceptable.
