2.1. Data description

2.1.1 Introduction

This metadata information is provided by Spanish authorities to ensure compliance with the requirements of Article 6 of Regulation 862/2007 on Community Statistics on Migration and International Protection.

As required by Article 9 of the Regulation 862/2007, Member States must report to Eurostat on the data sources used, the reasons for the selection of these sources and the effects of the selected data on the quality of the statistics. Member States shall provide it with all the information necessary to evaluate the quality, comparability and completeness of the statistical information.

The reference terms for the assessment of quality compliance are provided by Eurostat in the Residence permit statistics technical guidelines applied for 2015 reference period (See section 3.4 Statistical concepts and definitions from the Residence permits statistics ESMS file).

 

2.1.2. General description of the statistical domain at national level

National system for compilation of residence permits statistics (level of development, main changes that affected the system in the last years and further development)

The unit responsible for compiling the residence permit statistics is the Permanent Observatory for Immigration (General Secretariat for Immigration and Emigration – Ministry of Labour, Migration and Social Security).

 

2.1.3. European and national legal framework relevant for Residence permits statistics

 EUROPEAN LEGAL FRAMEWORK:

 - The Directive 2009/50/EC of 25 May 2009 on the conditions of entry and residence of third-country nationals for the purposes of highly qualified employment is applicable.

- The Directive 2011/98/EU on a single application procedure for a single permit for third-country nationals to reside and work in the territory of a Member State is applicable.

 

2.1.4. Institutional infrastructure

List of the institutions involved in managing the registers related to Residence permits statistics and the institutions involved in the compilation of the Residence permits statistics

The Ministry of Interior, in collaboration with the Ministry of Territorial Policy and Public Function (through immigration offices), is responsible with the data collection and with the management of the main residence permits database, called Central Register of Foreign Nationals(National General Directorate of the Police). Additionally, the “Ministry of Labour, Migration and Social Security” is responsible with the data collection and with the management of the residence permits of two special procedures that complete the Central Register of Foreign Nationals.

The unit responsible for compiling the residence permit statistics is the Permanent Observatory for Immigration (General Secretariat for Immigration and Emigration – Ministry of Labour, Migration and Social Security).

 

2.1.5. General procedure for issuing first residence permits at National level

Residence permits are recorded in the Central Register of Foreign Nationals upon issuing to the permit holder. At national level, the definition for initial residence authorization follows the national legal framework and it is not comparable to the definition of first permit.

First residence permits (Tables RP1-RP5) are calculated through different date variables. Flow data are compiled by the Permanent Observatory for Immigration following the technical guidelines for data collection under Article 6 (Regulation 862/2007). 

 

2.1.6. General procedure for recording change of status or reason to stay of the permit (reason)

RP5 (change of status or reason to stay) are compiled mainly using the files obtained from the Central Register of Foreign Nationals.

Previous and new permit are analysed and change of status or reason to stay are recorded if these two conditions are met:

1.- The time gap between the expiry of the previous permit and the start of the validity of the new permit is shorter than 6 months

2.- A new permits was issued with different immigration reason.

 

2.1.7. General procedure for recording all valid residence permits at the end of the year

RP6 (all permits valid at the end of the year) and RP7 (long term permits) are compiled using the files obtained from the Central Register of Foreign Nationals.

The general procedure for recording all valid residence permits at the end of the year is that the data of issuance is equal or before the end of the year and the end of the validity is after the end of the year.

 

2.1.8. General procedure for recording residence permits for Highly Skilled Workers and EU Blue Cards

Single permits are compiled using the files obtained from the Central Register of Foreign Nationals. This kind of permits are classified on the bases of the specific modality of the reason to stay taking into account what it is included as single permit according to the national legislation.

Since 1996, official residence permit statistics for stock data are compiled and published biannually at national level (methodology is not comparable with Residence permits statistics for Regulation 862/2007). Flow data for residence permits are compiled and published at national level annually but definition for first, renewed and changedare different and therefore not comparable either.

The statistics collected under the Regulation 862/2007 are widely used in official publications and by a wide range of users at national, European and International level. The Residence permits statistics are regularly used by national administrations, academic researchers and civil society groups working on a wide range of topics including the integration of immigrants, the development and monitoring of national asylum and immigration procedures, and the projection of the future population and labour force.

At European level, the main users of Residence permits statistics are Eurostat, OECD and DG Migration and Home Affairs. These statistics are used in several publications of the Commission, as well as in the preparation of regular reports, policy proposals and analysis.  The statistics also provide an input to the European Migration Network (EMN) studies and reports that address specific issues of current policy importance.

Stock and flow data for Residence Permits are published at national level. The categories published at national level are not comparable with Eurostat data. This is due to the fact that the categories published at national level are based on national legislation while data provided to Eurostat follows the Guidelines for the data collection under art. 6 of Regulation 862/2007. They have different methodologies and they are not comparable.

Every year, the classification of the categories are revised and the magnitude of changes are also checked for every category and cross classification. When a significant variation is found, the causes for such change in the series are studied. The reason of the variation could have a clear explanation or it could be an error. In case of error, the programming process is revised and/or the classification of the categories. Subsequently, the data is obteined again and the series are revised if needed in order to make the data comparable over time.

- Detect and delete those third country nationals who have acquired the Spanish citizenship

- Detect and delete those third country nationals who had passed away but had a valid residence permit at the reference year.

- Changes in the classification of some categories. Mainly permits that are granted to third country nationals for reasons related for family formation and reunification which have been moved from the category “Other” to “family reunification”

- Detect and delete in RP7 those long term residence permits lasting less than five years (mainly children born in Spain).
