1. Introduction

This metadata information is provided by Austria's authorities to ensure compliance with the requirements of Articles 5 and 7 of Regulation 862/2007 on Community Statistics on Migration and International Protection.

As required by Article 9 of the Regulation 862/2007, Member States must report to Eurostat on the data sources used, the reasons for the selection of these sources and the effects of the selected data on the quality of the statistics. Member States shall provide it with all the information necessary to evaluate the quality, comparability and completeness of the statistical information.

The reference terms for the assessment of quality compliance are provided by Eurostat in the EIL technical guidelines (See section 3.4 Statistical concepts and definitions from the EIL ESMS file).

 

2. General description of the statistical domain at national level

EIL National System (level of development, main changes that affected the system in the last years and further development) EIL Data (containing personal information as well as status information) are processed by the competent asylum authorities. They are transmitted in due course by file transfer to the Central Foreigners Register (Zentrales Fremdenregister - IZR). The department responsible for statistical analysis at the Federal Ministry of the Interior receives data extracts from IZR on a daily basis for evaluation purposes. These are stored in a separate database, of which Statistics Austria receives extracts of individual data for data processing of European EIL statistics. Prior to 2014 data has been stabled in a different database called Asylum Information System (Asylinformationssystem - AIS). The main advantage of moving data to the IZR is that this database will, when fully developed, contain all relevant administrative information on foreigners in a single database - stretching from possible asylum applications via asylum decisions to any residence permit issued and also possible information of the foreign police.   Legal national framework relevant for EIL statistics Regulation (EC) No 862/2007 on migration ans international protection.   Institutional infrastructure (list of the institutions involved in managing the EIL registers and the institutions involved in the production of the EIL statistics) Borders Police. 1. General aspects

The statistics collected under the Regulation 862/2007 are widely used in official publications and by a wide range of users at national, European and International level.

Main users of EIL statistics at national level

The EIL statistics produced are regularly used by national administrations: academic researchers and civil society groups working on a wide range of topics including the integration of immigrants, the development and monitoring of national asylum and
immigration procedures, and the projection of the future population and labour force.


Main users of EIL statistics at European and International level

The main users of EIL statistics are Eurostat, DG Home Affairs and EASO. The statistics are used in several publications of the Commission, as well as in the preparation of regular reports, policy proposals and analysis. The statistics also provide an input to
the EMN studies and reports that address specific issues of current policy importance.

 As described under 6.1 a few retrospective cases may be missing, as they may only be entered after data processing and transmission to Eurostat has already been finished. However the number of retrospective entries missing is assumed to be less than 1%.

For reference year 2022 EIL Y2 could not be provided by the Deadline of 31 March because Statistic Austria's data provider did not deliver the required data in time. EIL Y2 2022 was transmitted on 25 April 2023.

The term "not applicable" relates to the categories of permits which do not exist in national legislation/administrative procedures
and therefore such statistics cannot be issued.
 
The term "not available" relates to categories of data that exist in the national legal/administrative system but cannot be delivered
under EIL data collection for various reasons (e.g. data cannot exist, data exist but are not collected, data are unreliable, etc.).
 
Statistics Austria is aware that some information in this Metadata is missing. We are waiting for input from the Federal Ministry
of the Interior and will provide the missing details as soon as possible.

Comment on EIL Y3 2022: Consistency issue between categories. For each CITIZENSHIP category that record more than 100 persons, the total returned persons should be with maximum 30% more than the persons receiving the decision to return”. The reasons for why the Austrian data do not fit into this rule are:
  • Particularly in the case of nationals from the Western Balkans, there are often already existing entry/residence bans or return decisions issued some time ago (in some cases with multiple departures), which is why there were more departures than "new" return decisions in 2022.
  • According to Austrian law a new return decision for existing entry/residence bans cannot be issued (unless the facts of the case have changed significantly).
  • In addition, there are some illegal residents who leave the country voluntarily at the request of the Federal Office for Immigration and Asylum in order to avoid the issuance of an entry/residence ban. In such cases, return decisions are often issued belatedly.
