The public consultation invites stakeholders to provide input on the review of the lists of product and service markets within the electronic communications sector susceptible to ex ante regulation (Recommendation on relevant markets - 2007/879/EC). This consultation will be open until 8 January 2013.
The consultation is open to all citizens and organisations concerned with the market-based approach to regulation within the electronic communications sector in the EU.
Contributions are particularly sought from public authorities (including National Regulatory Authorities and National Competition Authorities), the Body of European Regulators in Electronic Communications (BEREC), Member States, the electronic communications industry, research institutions and universities, consumer advocacy groups and other interested parties.
Period of consultation
The public consultation will last 12 weeks.
It is open from 16/10/2012 until 08/01/2013.
Purpose of the consultation
More than four years after the current version of the Recommendation on relevant markets has been adopted, it is appropriate to review the list of relevant markets. The review will allow taking into account major market and technological developments, such as internet-based applications and services, the convergence between different types of networks and services and the development of Next Generation Access networks and services.
The appropriate identification of relevant markets susceptible to ex ante regulation is key to the overall functioning of the EU Regulatory Framework (Framework Directive 2002/21/EC and Specific Directives applicable to electronic communications networks and services). It allows the National Regulatory Authorities to focus their regulatory efforts on markets where competition is not yet effective and which are crucial for Europe's competitiveness. Having a list of pre-identified markets helps National Regulatory Authorities to regulate these markets in a coordinated manner, thereby contributing to the development of the internal market. A stable and pertinent list of relevant markets is also vital for providing market players with legal certainty and thus stable business planning.

The Commission invites the stakeholders to submit written views and comments on the issues raised in the questionnaire. Responses to this public consultation should reach the European Commission by 8 January 2013 at email@example.com . Please note that there is no need to provide a hard copy in addition to your contribution provided electronically.
The questionnaire is only available in English.
