The European Commission has just launched a public consultation to prepare the review of the Significant Market Power (SMP) Guidelines, dating from 2002. The goal is to update the guidelines in time for the implementation of the new European Electronic Communications Code. The European Commission will soon launch a call for tenders for a service contract of a maximum value of EUR 135.000. The main objective of the study is to gather relevant information to assist the Commission in evaluating to which extent amendment of the SMP Guidelines is necessary. In this respect, experience of the NRAs and of the Commission with the application of the regulatory framework and developments in the jurisprudence of the EU Courts and of national courts will be taken into account (SMART 2016/0015). The European Commission has opened an in-depth investigation over the price caps for the fixed termination rates proposed by the German telecoms regulator BNetzA. The Commission intends to investigate further, in cooperation with BNetzA and BEREC, whether there are adequate grounds for setting price caps considerably in excess of the initial result of the cost model used by BNetzA. The European Commission has opened an in-depth investigation into the Dutch telecoms regulator's (ACM's) analysis. While ACM finds that the fibre lines in the market in question are competitive, it concludes that KPN has Significant Market Power (SMP) and its copper lines in the same market need to be regulated.
