The European Regulators Group for Audiovisual Media Services (ERGA) adopted today an Opinion on the practical implications of the AVMSD proposal.

The opinion was adopted on 5 October 2016.

ERGA has looked at the AVMSD proposal from a practical point of view, from the expert perspective of the audiovisual national regulatory bodies. It analysed the consequences of the proposed provisions in terms of day-to-day application if they become European law. ERGA also looked at what would be the implications and needs when applying and enforcing the proposed rules.

The ERGA opinion discusses in detail the practical consequences of the AVMSD proposal in the following areas:

  • Scope of the Directive
  • Video-sharing platforms
  • Commercial communications
  • European Works obligations
  • Protection of minors
  • Territorial Jurisdiction
     

ERGA also gives practical views on the new provisions on independence of regulators and its future status and operation.
