The European Commission launches a targeted consultation on the review of the Recommendation on relevant markets in the electronic communications sector adopted in 2014 (2014/710/EU). The aim is to gather information on the state of play and developments of wholesale markets and assess current and potential markets susceptible to ex ante regulation in the sector. The results of the targeted consultation will support the Commission’s preparations of the new Recommendation to be adopted by 21 December 2020.

The appropriate identification of relevant markets susceptible to ex ante regulation is key to the overall functioning of the EU Regulatory Framework and it has been confirmed as a key regulatory tool in the new European Electronic Communications Code. It allows the National Regulatory Authorities (NRAs) to focus their regulatory efforts on markets where competition is not yet functioning effectively. Having a list of pre-identified relevant markets subject to ex ante regulation helps NRAs to regulate these markets in a coordinated manner, thereby contributing to the development of the internal market. A stable and pertinent list of relevant markets is also vital for providing market players with legal certainty and thus stable business planning.

The Commission will review the current Recommendation to take into account major market and technological developments (such as the deployments of 5G networks, internet-based applications and services, the convergence between different types of networks and services and the development of Next Generation Access networks and services) and to reflect the overall observed and expected market trends in the Member States.
