Fundamental Principles of Transnational Civil Procedure

The American Law Institute and UNIDROIT (the International Institute for the Unification of Private Law) are currently working jointly on the elaboration of “Fundamental Principles of Transnational Civil Procedure”. This project endeavours to draft procedural rules that a country could adopt for adjudication of disputes arising from international transactions.

The draft stresses that harmonisation of the law of procedure has made much less progress than that of substantive law, but that harmonisation is possible also in procedural matters. Although the draft does not directly address simplified and accelerated procedures, many of the procedural issues the draft deals with are of relevance for these procedures.
