ID 1116. Use of non-EEA agents
Relevant provisions
General question on Directive 2009/110/EC
Question
Please let us know whether there are any issues, restrictions or guidance with the engagement of non-EEA agents or non-EEA distributors by a licensed e-money institution or payment institution, to carry out services in other EEA States.
Answer
The E-money Directive provides not for any specific restrictions related to the nationality or the origin of an agent or distributor. Therefore a licensed e-money institution or payment institution would be allowed to engage non-EEA agents or non-EEA distributors to carry out services in a Member Stare as long it complies with the relevant laws of that Member State.
