The amendment of Regulation (EC) No 216/2008 (the ‘Basic Regulation’) in 2009 extended the responsibilities of the European Aviation Safety Agency (the ‘Agency’) to aerodromes. This new responsibility mandated the Agency to prepare draft safety rules for aerodromes as well as common rules for certification and oversight by the National Aviation Authorities (NAAs) in support of the European Commission. Proposed Implementing Rules contain the conditions for the issuance of certificates, the obligations and privileges of certificate holders and sanctions in case of non-compliance. The Implementing Rules are divided in sections; Authority Requirements, Organisational Requirements and Operations Requirements. The Agency will adopt Acceptable Means of Compliance (AMC), Guidance Material (GM) underpinning the Implementing Rules and allowing for their harmonised implementation across the Union. The Agency will also adopt Certification Specifications (CS) which to a large extent will replicate provisions issued by the International Civil Aviation Organisation (ICAO).
At the end of 2013, when the Commission is expected to adopt the new rules, they will become applicable to aerodromes that are open to public use, serve commercial traffic, and that provide instrument approach and departure procedures, and that have paved runways of more than 800 meter or exclusively serve helicopters. Small aerodromes with passenger traffic of less than 10000 passengers or 850 cargo movements per year may be exempted by the Member State.
