La farmacia en España se caracteriza por el inmovilismo corporativo. Toda su legislación se basa, en una serie de leyes sólo y exclusivamente adaptadas a los farmacéuticos con farmacia. Estas leyes (tanto nacionales como autonómicas) apoyan un sistema gremial y obsoleto que debería estar en total desacuerdo en un país democrático que asienta su economía en el libre mercado y que ha de preservar la igualdad de derechos de todos sus ciudadanos tal y como marca nuestra Constitución donde claramente se
vulneran algunos articulos (art. 14 de la Constitución Española), el artículo 14 de nuestra Constitución establece imperativamente, para todos, también para los farmacéuticos sin oficina de farmacia, "Los españoles son iguales ante la ley, sin que pueda prevalecer discriminación alguna por razón de nacimiento, raza, sexo, religión, opinión o cualquier otra condición o circunstancia personal o social". Respecto a Europa, esta ha demostrado en un
dictamen motivado que ha enviado al Reino de España, donde en virtud de su art. 226, parrafo primero, debido a determinadas restricciones en materia de establecimiento de farmacias, ha instado al reino de España a adoptar las
medidas adecuadas en el plazo de dos meses, desde la fecha de su publicación, para atenerse a dicho dictamen. En dicha carta la Comisión hace constar que varias disposiciones de la normativa española plantean incompatibilidad con el
Derecho comunitario y, en particular, con el articulo 43 del Tratado CE relativo a la libertad de establecimiento.
Son sus fines:
1º.- Promover, concienciar a la sociedad, así como sensibilizar a ésta, de la necesidad de la igualdad de derechos y deberes de todos los profesionales farmacéuticos.
2º.- Intercambiar experiencias de trabajo y facilitar la colaboración y elaboración de programas conjuntos entre las plataformas territoriales.
3º.- Estudiar la realidad jurídica existente y promover en consecuencia los marcos jurídicos que permitan llegar a la libre apertura de Farmacias .
4º.- Servir de portavoz de sus planteamientos ante los foros nacionales e internacionales.
5º.-Impulsar y consolidar las plataformas provinciales, autonómicas y asociaciones a todos los niveles para que se dé respuesta a las necesidades sociales que se planteen.
6º.- Así como cualquier otra finalidad de fomento, desarrollo y fortalecimiento de la profesión farmacéutica.
Para conseguir estos objetivos LA PLATAFORMA PARA LA LIBRE APERTURA DE FARMACIAS, promoverá y realizará todas aquellas actividades tendentes al mejor desarrollo de los mismos.
